Montana had no official daytime posted speed limit for a few years but scrapped it. It was ruled "unconstitutional." :shock:
so to pass someone that drives 75 in a 80 zone, you only can speed up to 80?

If this is in the GTA, the Prosecutor is less likely to offer a deal for this kind of charge. But you may be able to negotiate something like Green Light - Fail to Proceed as Directed, or Disobey Lane Light, or whatever, depending on your driver record, etc.

Just to be clear, were you charged with HTA 144 (18 ) Red Light - Fail to Stop, or HTA 144 (15) Disobey Amber Light?

In traffic tickets matters, though, if a defendant brings a picture and certifies it he/she was the author and that the picture has not been altered, the picture should be accepted. The prosecutor may challenge the veracity of the picture, but the objection MUST be based on evidence not just on unfounded suspicion.

Whether under caution or not, a statement could still be used in court as evidence, as I have used it many times. What happens is we go into a "voir dire" (a trial within a trial) to determine how and what context the statement was made. I think to answer cruzmisl's original question... I believe that if you have insurance on your old vehicle, it's valid on a new purchase for 14 days. But check with an insurance company first...
