Re: G2 Licensed Driver with 0.01 blood alcohol level
These have been tested over and over in criminal court by some of the best criminal lawyers. They are reliable. Mouthwash can be accounted for. If there was mouthwash present you would have blown a "F" and been arrested and taken to the full breathalyzer which by the time you got to that location would have left your mouth thus producing the .01 ...

I canot remember the case law name but it starts with a "W". I think the ticket was reduced on the side of the road. You will now be fighting the ticket on the original un-reduced speed.

The warning does not go on a record. It is only tracked internally in the police service. There is no conviction.

Plus here we use electronic ticketing. Once we hit print the ticket is electronically submitted. Therefore there is nothing to tear up.
You say the slip is the same as the new one same company and policy. How is the cop supposed to know that. For all he knows the vehicle has no insurance as the slip is expired.

Its a warning. Nothing needs to be done. It is just a way to track internally that she has been made aware that she has to have a valid insurance card ready to produce.

We can run plates in the car. This gives us the provinces status no matter where the plate is from. No matter what the sticker says we know if it is up to date.
I run out of province plates all the time. We have a very transient population and many do not transfer their regs or keep them up to date and current.

In Ontario the HTA is clear. All suspensions are deemed served after 7 days. As for family responsibility suspensions I highly doubt that you were not aware. It takes a lot of correspondence to get to that point and you knew you were not paying the child support.

I have done it. Based on your other thread, Having a G1 with no accompanying driver and the fail to produce the G1 as it supersedes any other DL, International or not, is going to cost you more than the fail to produce insurance card.

No. It is really not that hard. See your head does turn and allows us to follow the vehicle. Plus, the split second that you check to make sure you are not struck is accepted by the courts as reasonable.

I only give three tries. We can usually tell when someone is trying to beat the test. Plus the instrument has lights and error codes that tell us when the person blowing is playing games.

I believe it has no effect for the at fault insurance rules. Plus in this case you were not found not guilty. Or proven that the facts if the accident were not correct. The charges were withdrawn due to a witness not showing up.

There is a good chance they have marked your tire with chalk. That is what they do here and it is accepted practice. The chalk mark is usually on the tread and is hard to see if you are not looking for it. It is not something you will just notice.

Stopped at a light is not parked. To be parked you need to be off the roadway or stopped lawfully and not impeding traffic.

Wrong forum. Criminal matters are much more serious and you should get a lawyer. Criminal matters are not usually tossed from wrong dates. They are not fatal and dealt with by a new appearance notice if the court date is wrong.

Keys in the ignition means nothing to the charge as does the fact that you were stopped on private property. They saw you drive on the road. If you had blown over 80mg you would have been arrested for the impaired driving just the same.
