My understanding is that "highway" is property line to property line, not just the paved portion. I think all HTA applies to the full road allowance (limit to limit) including sidewalks.

There's a little know law that one must stop before crossing a sidewalk when exiting a private drive. No one does it and I have never heard of this charge being laid. I can't find it now in the HTA but I had read it before after losing a bet against a cop about it, LOL.

I actually HAVE a possible solution, but it's a tad "way-out" there for most folks to really understand. As a world-champion online NASCAR champion (2006), I can honestly say they have really got PC based driving simulators figured out!!

Graduated licencing imposes restrictions that result in LESS driving in a given period of time. Most 16/17/18 yr.olds now have to wait till mom and dad come home from work before they can take the car for drive around the block. And thats IF mom and dad aren't too busy to take them. You might want to reconsider what you believe to be a safe following distance. I teach my kids to pretend someone is passing you (probably ME) and they might need to get back in line in front of you. I think that even if the other car DID have a green, he has raised enough reasonable doubt as to the proper operation of the signals. It's reasonable to assume the lights were not functioning properly based on the evidence from the electrical company.

Definitely fight this one.

Your court date is now and you are prepared to proceed. It is not your fault the crown is not prepared. As backup, you might want to have your lawyer print you out the case ...
