I agree with you "T" and get your point. It's very easy to "feel" like you can do other things when crawling along at a ridiculously slow pace. Society generally accepts distracted drivers, otherwise drive-through windows OF ANY SORT would be banned! Just sit and watch the exit to a Tim Hortons. Absolutely horrible stuff happens there.

Personally, I wouldn't mention the cruise was on. You'll then be pressed to admit you had it set 10-over. You will have admitted to speeding in a court of law and you will be convicted. Definitely request Disclosure to see if you have already admitted to speeding to the officer.

Normally, I wouldn't talk to the Crown. I'd just go ahead and fight the charge. But in this case, I would definitely explain the conditions to the Crown and ask that he offer you a non-moving violation instead (perhaps "improper muffler"). No points and your insurance company will consider it minor (no rate increase).

You guys might be right. But I always thought they didn't have to write the section no. down if the wording was specific enough to describe the offence (without any possibility that it could refer to more than ONE offences in the Act).

My unprofessional opinion is that the "Fail to Yield from Driveway" charge IS specific enough to warrant a conviction. If it just says, "Fail to Yield", that could apply to various sections of the HTA and would justify a dismissal if she motions for one ...

The Crown doesn't want to go to trial any more than you do! Explain that your insurance company will jack your rates sky-high if you get points. I'm sure he'll be much more likely to accept YOUR plea offer if he see's that you are aware of the ramifications involved.

I see slow drivers blocking the left lane every time I'm on the 401. Though I realize many in this province feel it's some sort of insult or threat, I flash my high-beams (passing beams) all the time. Sometimes it works... usually it doesn't.
