Re: Fail to obey stop sign sec. 136(1)(a)

I'm pretty sure I hold the record for MOST tickets on this forum (over 20) and I have never seen "points" listed on any on of them. If it turns out they were supposed to be there, I can't wait to tell everyone that, technically, I have a completely clean record!! :D

Re: Stopping two cars

Last month I received data that showed a survey bar in the middle of the street. When I asked my party-chief, "What the heck?", he came to the realization that the laser reflected off the taillight of a passing car instead of his prism.

This may not happen with police systems, but a JP might entertain the possibility :P

Will let you know when I ...

Re: Stopping two cars

I'm willing to bet the officer just assumed you were traveling at the same speed as the lead car.

I wouldn't put a lot of thought in to a defense until you read the Disclosure. The type of equipment the officer used will make all the difference in how you handle your questioning.

I suspect the Crown will be anxious to offer a plea to a lesser ...

I would definitely try to postpone this trial no matter WHAT defense you should choose, just in case you lose. You do NOT want 3 tickets within 3 years on your record... You insurance company will absolutely lay you to waste!

Careful... I read this a couple years ago and suggested a coworker take advantage of it. Upon further investigation, we were informed there were NO "prescribed parts of Ontario" at that time. Apparently, the section was written in anticipation of parts being prescribed at a future date.

I watched a 1-hour interview with Mr. Mulcahy on Legal Briefs with Lorne Honickman a few weeks ago. I felt terrible for him because he lost his 18-yr.old son at a very young age. When I listened to his pleas for "no tolerance" legislation with regard to drinking and speeding, I really did ...

Re: O.P.P officers avoid instant penalties!

Ahh yes. My bad. It's the potential for severe penalties that makes it Strict.

But this seems to fly in the face of the impoundment rules. How can a driver defend himself using a due diligence argument on the side of the road? Only the court can rule on such a defense, not an officer. It seems to me that this is the core problem with 172. To be ...

How could this be a Strict Liability offence? It's Speeding! If you sped, you're guilty, right? (no option for due diligence).

The witness was sitting right in the defendants vehicle observing the defendants speedometer. How could you get a more iron-clad case? OH WAIT, the defendant was a cop! That evens the playing field and all he has to do is ...

Tapp testified he wasn't paying attention to the speedometer but was going with the flow of traffic. He said he would never drive at such "ridiculous" speeds.
"Personally, it's against my code of ethics to travel at that speed," Tapp testified.

Re: car-bicycle accident- fail to remain...

Bookm, there is no speed limit or default speed limit on a sidewalk or signs would be posted or a regulation or by-law is required. Common sense indicates the speed limit, however, would be no more than the speed limit on that given street.

I agree, it is poorly written. I get the jist of it (cyclists are to WALK in an area designated for pedestrians) but the word "along" could clearly be used when riding along the edge of the road and crossing straight across the intersection.

I misinterpreted your scenario. But I still see fault on your behalf if you rode out into the crosswalk . You were riding on the sidewalk and continued straight out into the crosswalk, still riding. If this is the case, the charge seems to be applicable.

I believe the stop signs are placed as a cheap way to prevent serious accidents should a driver not realize he is going the wrong way on a one-way street.

This won't come as a surprise to most here ;) but I think we should have abolished the "complete stop" element of traffic law a long time ago. Many European countries prefer a "yield" type system and it makes sense.

It is substantially more exhaustive to get a vehicle moving from a stop than it is to move from a "rolling stop". I can just imagine ...

Your right! I'm not...

In your reply you used beer and mouthwash as examples. Both these are not pure alcohol. They are mixed with water. If a suspect is bleeding in his mouth, his blood is constantly ...

From Wiki:

Mouth alcohol

One of the most common causes of falsely high breathalyzer readings is the existence of mouth alcohol. In analyzing a subject's breath sample, the breathalyzer's internal computer is making the assumption that the alcohol in the breath sample came from alveolar air—that is, air exhaled from deep within the lungs ...
