I should add:
There was absolutely no evidence of excessive speed on the cars part. It must not have had anti-lock brakes, because we heard the screech before the bang and there was about 15ft. of skid marks (speed limit 70kph). It was banged up but no where near what high speeds would have produced.

In no way am I suggesting the cop didn't record the speed of the passing vehicle. I'm just suggesting he MAY have needed to increase his speed for safety reasons based on the actions of the vehicle being passed.

I've seen prosecutors plea bargain a Careless charge down to Following too Close in the same situation (a guy gently rear-ended a car stopped at a red). Sounds like the cop might have been giving you a break.

When ever I've been in court, the officer clearly states that he was patrolling in uniform and in a plainly marked cruiser.
I've never been charged by an un-marked cruiser and always assumed they must be marked to do traffic detail. I now know that NOT to be the case.

Do you really think the oncoming vehicle (the officer) was able to get the speed of the passed vehicle AND the passing vehicle throughout the entirety of this scenario... with moving radar?? Sure it's possible, but unlikely. I'd love to put this cop on the stand:

No. I'd bet large that if the stop sign had run across the road, it would have been seen and stopped for, just as a child would have.

The cop wrote two tickets because he knows the Crown will likely offer to drop one for a guilty plea on the other.
The ownership one would likely be dropped if she were to show the Crown that the original IS signed. But if it were me, I'd try to negotiate a guilty plea on the ownership and have the stop sign dropped.

There is a section in the Provincial Offences Act that appears to facilitate this type of trial in "prescribed parts of Ontario". The intention seems good, until you find out that there are NO "prescribed parts of Ontario" that allow it, LOL.
