I recall reading about a strategy of not requesting disclosure at all! Trial by ambush I think they called it. Then ask for dismissal if ALL relevant documents aren't produced by the crown at trial. Any thoughts?

Fact is, I don't know how much alcohol intake in how much time will produce 0.04% blood/alcohol level. The officer COULD have educated you about all these issues by explaining the laws then issuing a warning to correct the deficiencies. Unfortunately, this modern era of policing seems to associate performance with number of tickets written.

Scan your ticket and keep it safe. You never know when you'll lose the paper copy. If you have all of your documents scanned, you can at least reprint whatever's missing.

If everyone drove at 100km/hr or even 120km (hey I'll give you that for arguement sake right now) Or better yet the gov't speed govenor at 105km/hr and not 1km faster or slower....no one would catch anyone, no one would pass, and traffic would just flow consistently.

At the very least, I would call the Crown and try to plea bargain down to a lesser offence.
You could also call a ticket fighting company in Ottawa and have them represent you.

Bear, that's funny AND sad at the same time. this is a prime example of where lawmakers had good intentions but failed to predict the inevitable consequences of people not understanding the headlight system in modern cars. The factories did their job, but who taught all the naive drivers out there about the new system.

You really don't want to risk a 172 conviction by relying solely on comments from members of a traffic forum (as knowledgeable as some of them are). We always rode in the back of buddy's pickup. I understood the law to say it was legal as long as all cab seats were occupied and seatbelted in. If it's changed, I didn't hear of it.

Wow, lucky break! I thought maybe you just wrote a typo in your thread.
The ticket is the charging document. It has to be sufficient on its own to describe the offence. The wrong section number is a fatal error. It can't be amended by the JP.
1) Plead not guilty on back of ticket
2) Deliver to court house (address on back)
3) Wait for trial

I wrote out a defense for a stop sign ticket I got a few years back. I had to plea bargain to get two others dropped, though, so I didn't get to try it out in court. But you might pick up a couple tips from it.

My driver's ed consisted of driving from one garage sale to the next. Never left the city limits. Never drove above 55kph. At 16, my first car was a slow Astre (Vega). At 17, I bought by first V8 (1969 Ranchero, 351W, 4-spd). I took it out on the 401 for the first time and thought I had found heaven!!!

There is no doubt in my mind that the most dangerous scenarios I face on the 400 series highways is that sudden wall of brake lights ahead that seam to appear for no reason... that is until you get a little further along and see the cruisers running a blitz.
