I am gonna file for a stay by filing Form 4F. Since I was not provided proper/full disclosure. Since I referred to case laws R. v. Stinchcombe and R. v. O'Connor each being 27 pages and 140 pages respectively. Am I suppose to attach the whole case file in my appendix of Form 4F or just part of it? If just part of it then which part? I am going to be needing 3 copies of Form 4F with the appendix to submit, that is ALOT of printing. Thanks

A lot of times if they see that you have a big file (or pile of papers) they just drop the charge. My Case (officer present no evidence) Geet out of here. Cheers Viper1

Our prosecutor sees these big files as a game...now it's a challenge... You come to court to snow ball, he'll not withdraw...they aren't prepared to be outmanoeuvred but some tree slaughtering wannabe (his words not mine) LOL!! Different prosecutors approach it differently...

Alright, I have decided to just include the overview of the case laws as provided in the Canlii in my Form 4F appendix, is that a good idea? Just going to include in: R. v. Stinchcombe, [1991] 3 S.C.R. 326 http://www.canlii.org/en/ca/scc/doc/199 ... nlii45.pdf Pages 1-3 only and R. v. O'Connor, [1995] 4 S.C.R. 411 http://www.canlii.org/en/ca/scc/doc/199 ... nlii51.pdf Pages 1-16 only

My husband was driving my car and passed a school bus with flashing lights. He did not realize this until he was past the bus. The driver honked at him but there were no cops nearby and he didn't get pulled over. I believe the driver or witnesses reported this and we got issued a…

Hi, last summer I was pulled over when I made a left turn from he middle lane at Harbor and Yonge Street (heading east on the Gardiner and taking the Yonge exit). I swear they nabbed about 10 people in 5 minutes. Anyways, I decided to challenge in court, my court date is in April and I have just…
In Kanda, the court established that this offence is a strict liability charge. In other words, you can offer a defence of due diligence. In Kanda the defendant explained the…
Last July I got pulled over for failure to obey stop sign at a T-intersection in my neighbourhood. After I got my trial date I requested disclosure in November. Sent in another request for disclosure in early January and in mid-January got a call to pick it up at the court office. The disclosure…
