Unread post by Screwed »

Anyone know how backed this courthouse is? I submitted my ticket for trial at the end of August, and still no letter. Im scared it got lost in the mail, can i call the courthouse and find out my courtdate? Or would i have to go in personally?

I think they're pretty much backed. When I was there in a court room back in December of 2010 I saw people pleading guilty for tickets issued in July/September of 2009, that's more than 14 months.

Did you request a date for trial in person?

I pleaded the third option on the ticket. My sister went in for me to file the ticket

Yep, that courthouse covers all of Scarborough and parts of East York. HUGE backlog. Lots of cases dropped/stayed due to 11B (unreasonable delay) filings.

Also, since my ticket was for a fail to stop at stop sign, im entering university next year and will be strained for time, what do you think my chances are for having a successful 11b motion?

I think there's a phone number on the back of the ticket.

If they set the trial 11 months after the ticket was issued, then you're chances for an 11b are good.

You'll have to wait for the notice of trial to arrive though. When that happens, request disclosure.

You can call your paralegal and ask them if the trial has been scheduled. Chances are, it has not. I'm currently in the process of contesting a ticket at the same courthouse and it took over eight months just to get the Notice of Trial. If you are in doubt, you can call Court Services yourself and they'll tell you.
