Hey Guys, It's been a while since I've used this forum (Haven't been charged with anything in 3 years, so I've cleaned up my act.)
Yesterday, I was pulled over and charged with Speeding 130 KMH in a Posted 100KMH zone on the 401. The officer was nice and polite, as I was with him, and charged me accordingly. However, when I did the math, the Set ...

Re: Electronic Proof of Insurance Cards - accepted by LEOs?
Question regarding "format approved by the superintendent". My Insurance slip expired a couple months ago, and I did not receive the updated slips, so I called my insurance company and they emailed me a valid slip, which I printed out. Would this be sufficient enough, or does this technically not count as an approved format?

Re: class g1 driver unaccompanied by a qualified driver
There's been times where I've thought the cop wasn't the one who pulled me over. Maybe he got a haircut, or glasses or something. But Badge Numbers never lie.
I personally would consider this a win and move on. In your original post, you never mentioned the Fail to Surrender Driver's License Ticket. What I'm assuming that happened is that you got ...

Re: License suspended after lost ticket, ways to delay?
@JSherk, I think the OP is getting confused with the Ministry Interview and the Novice Driver Escalating Sanctions. With the Ministry interview, you will have to go in and plea why your license shouldn't be suspended (6-9 points for G1/G2, M1/M2, 9-14 for G/M), where as with the Novice Driver Escalating Sanctions, it's an immediate suspension. On ...

Re: License suspended after lost ticket, ways to delay?
Unfortunatly, there is no way to delay it. What was the charge for? You said speeding, but did not say if it was Stunt Driving reduced to 49 over, or you just flat out lost at trial for a 30-49 over. Either way, the only way for it not to get the suspension is to win at trial, which you were unable to do. The suspension starts immediately, and does ...

From My Understanding, You can only request an adjournment before the trial starts, since that's what your adjourning. I don't believe you can question the officer pre-trial.

Re: Speeding ticket - court in 10 days
So the ticket was reduced (Code R), which means that if you take it to trial, the ticket would be amended to the original speed recorded (whatever it was he/she told you). Be aware that 1-49 over hold the same bearing as insurance is concerned, the only difference is 1) points (if you have a lot on your record like me, you want to avoid all as ...

Ok guys, Update here.
Had my trial yesterday. Spoke with the prosecutor before hand, I told her I was ready to proceed, and she said she was as well, and didn't want to offer me a deal. Officer was in attendence. There were 10 careless charges on the docket, most of them plead guilty to either "Unsafe Lane Change" or "Improper Left/Right Turn ...

Re: Careless Charge - No Accident
So I never took down the video, Unsure of why it was removed. Anyways, due to the severity of the charge, I think I will just seek a plea deal out of it. I was never willing to fight this one on my own (was going to hire a lawyer), just wanted opinions on whether I should accept a plea bargain (something I could do on my own), or hire a lawyer to ...

It actually isn't as bad as it sounds. I went in 15 mins prior to my meeting, had a seat. The MTO representative called me in, I sat down. After that, she asked how many offences I have outstanding which I told her, then she went through all of my ...

Ministry Interview
So I received a letter today saying that I need to meet with the Ministry to discuss my driving record. The standard 9 points interview letter. Currently, I have 4 points on my record, but I hit 9 in September (5 points expired that end of that month, and I got convicted of a 49 over which put me at 9). So what I'm trying to figure out is what ...

So I know this is very unprofessional, but I missed my trial date. I had the noticed posted on my fridge, thought it was September 30th (tomorrow), turns out it was September 20th! Anyways, am I at a lost cause here? I know theres probably no chance of me getting another trial. Maybe a reduced fine or something? Any advice is appreciated.

Little argument that came up in work today. I personally don't know the answer, so I thought I'd ask here.

Re: Careless Driving - Witness lives 700km away?
To my knowledge, in order to secure a conviction, the witness and the officer need to testify at the trial. So if the witness or officer (or both) don't show up, charges will be dropped.
The next bit of my post is my pure thinking, so it should be taken with a grain of salt.

I'm surprised this hasn't came up yet. Maybe because of your daughters age, but its relevant. Does she hold a G2 or a G license? If she has a G2, and is convicted of 30+ over, her license will be suspended for 30 days due to the novice driver escallating sanctions. Just keep that in mind when going to trial.

Re: Is a ticket likely coming my way
I am having a bit of a hard time recalling exactly how much I passed the line by, however my worst-case estimate puts the rear tire around the white line (either slightly before or slightly past it). My car was not sticking out far enough to impede any traffic in the intersection, and I think pedestrians had some room to cross without stepping ...

Re: Court date - How to tell if Officer is in court?
What I normally do is I sit at the front of the court, but not check in. Usually there is a long enough line checking in so you have enough time. As officer's arrive, they check in with their badge number with the prosecutor. Listen to the officer as they say their badge number, check your notice of trial, or your ticket to see if it matches. Once ...

Argyll I get your bias. I am not above bias either, I think cops are f'ing parasites.
So if you want to talk about someone looking desperate and disingenuous just ask a cop why he issues speeding tickets.

it doesn't matter either way; because as far as insurance are concerned (which is the main issue) a conviction regardless of points or fine, is still a conviction.
(yes the fine may be lower and points) but where mainly worried about our insurance rates nes pas ? :)
not arguing the rest of your points which are all valid ;)

Wow, I can't believe that is the deal you got. I think if you go to court that day, they might let you plea to the 129, and drop the permit if you show it, but it's the luck of the draw. Just go in nicely and say you will plead guilty to the plea if they drop the permit charge. If they're having a good day, they might.

I suspect my daughter may actually have been driving more quickly, as officers seldom issue tickets at only 15 km/h over the limit, even if it genuinely was a Community Safety Zone. The ticket does not show Code R, but I understand that's optional and does not affect the ticket. Is that correct?
Correct

Unpaid Fine - How long until suspension?
So I've been a bit busy moving houses, and I completely forgot to pay a ticket that I received (JP made a ruling of 30 days to pay). It was due on the 29th of July, and I just found the Notice of Fine and Due Date today (I received it before, totally irresponsible of me to not pay it before hand). I have made the payment in full today online, but I ...

Congrats! You have a fatal error. Either option #1 or 3 that you described will work. Option 1 would be ideal as you do not need to make a trip to brockville unless convicted. Whereas you would need to go to brockville to request a trial, and then to not show up for it, and if you get convicted, it would require another trip up.

You will not recieve disclosure unless you request for it in advance. If you did, Great, your trial will be posponed and will not be used against you. If not, they can use the delay against you if you try to apply for an 11b (if the trial takes longer than 11 months).
