1) There is no speed limit that is 109 km/h. You were speeding 109km/h in a 100km/h zone. First of all, you should have been in the right lane (as the left is for passing), and if he wanted to pass, lawfully he should go into the left lane to pass you. You should never increase your speed because a car wants to pass you.

30 over is 4 points but 20 over is still 3 points. How many points do you have because of accident?

In general, Accident's do not accumulate demerit points. If there was a charge laid with the accident (i.e. Careless, Following Too Closely, Failure to Turn to Avoid Accident, etc.) then the points from the charge would be on the record. But ...

Are you sure it says 159.1 (2). If so, that is an incorrect section and can be dropped due to being a fatal error.

If it is 159 (2), here's what the HTA reads:

The best thing to do is not hire a paralegal as yet. Go to your first apperance date, ask if you could review disclosure before you can plea. They usually will set another date for you. When you get a ticket, it looks like this.

If you look at the last page, it says DO NOT MAIL. This is the way majority of the tickets get written.

Then what you would do is take it to the courthouse, and file it, and fill out one of these forms.

When you submit the request for trial, they send it to the address listed on that form. I was issued 2 tickets with the incorrect address (license said my old address even though I changed it with MTO. That is correct. From what I was aware of, you MUST inform the insurance company of all drivers registered at the address. Failure to do so can result in policy cancellation (This is my common knowledge, someone else can correct me if I am wrong.).

As for your ticket question, in my personal opinion, I would just pay it, as it is a no points ...

Are you insured as an occasional driver? Or not listed on the policy at all? If you are listed as an occasional driver, your rates may go up. If your not on the policy at all, then it will not affect your father's insurance.

Thanks everyone for the responses. I ended up taking a cab and renewed my license. I'd rather pay $20 just to be safe then risk another HTA offense.
