Any way to request a trial without going in?
Anyone know if this is possible? I got a ticket in Vaughan last night for going 49 over (not reduced. Apparently got me on radar going 109 in a 60 believe it or not.) The ticket says I need to request a trial in Newmarket. Is there any way of doing it online? I think I remember reading somewhere that OTT Legal files it for $10, but I want to fight ...

Maybe if it was criminal the officer would introduce what you said, but for traffic court, HIGHLY UNLIKELY. I get pulled over probably once every 2-3 months, and I always remember what happened at the incident because it's significant. It's not something that happens everyday. What you say to a police officer, or what he or she says to you, may very well be used in court either against you or potentially for you. That's important enough a reason to record the interaction.

Being of a minority doesn't mean anything. I hate when people bring race into it. "Oh I got a ticket. The cop was a real ass because I was *insert race here*". If you get pulled over, there are two reasons for that. 1 - You are breaking the law, or 2 - They suspect you may be breaking the law. Plain and Simple.

They have 6 months to issue new Highway Traffic Act charges, so since it's more than six months that should not be an issue. Now if there is some kind of Criminal Code charge that they could lay because of the video that is a different story. So assuming there is no Criminal Charges then you are fine.

Since there is a stop line, yes, you are considered in the intersection after crossing that line. If there was no stop line, then it would have been the cross walk lines, and then you would have gotten charged. It would depend, which ever car was in front would be determined to be going faster (physics), so if your GTI passed the other GTI, then of course you would get the ticket. If you stretch it out as long as possible it might be a good way to handle this so one ticket drops off your record before the conviction for the 2nd one is registered. I would make sure you fully understand what your insurers policy is as it is unusual if they only hold a conviction against you for a year.

If I'm not mistaken, Didn't you receive a Red Light - Fail to Stop in May? What was the outcome of that. I'm pretty sure if the prosecutor sees a conviction like that on your record, they wouldn't reduce the fine.

So just note that if you go to trial, they will amend the speed up to 81 in a 50 (31 over) as that is what the officers notes say.
