Any way to request a trial without going in?

Anyone know if this is possible? I got a ticket in Vaughan last night for going 49 over (not reduced. Apparently got me on radar going 109 in a 60 believe it or not.) The ticket says I need to request a trial in Newmarket. Is there any way of doing it online? I think I remember reading somewhere that OTT Legal files it for $10, but I want to fight ...

Re: Got pulled over for driving a rental car. Legal?

Maybe if it was criminal the officer would introduce what you said, but for traffic court, HIGHLY UNLIKELY. I get pulled over probably once every 2-3 months, and I always remember what happened at the incident because it's significant. It's not something that happens everyday. I can't remember what car cut me off this morning, because that happens ...

Re: Got pulled over for driving a rental car. Legal?

What you say to a police officer, or what he or she says to you, may very well be used in court either against you or potentially for you. That's important enough a reason to record the interaction.
You have to be really naive to make that comparison and not be able to see the difference there.

Even if you record the interaction to use in ...

Re: Got pulled over for driving a rental car. Legal?

Being of a minority doesn't mean anything. I hate when people bring race into it. "Oh I got a ticket. The cop was a real ass because I was *insert race here*". If you get pulled over, there are two reasons for that. 1 - You are breaking the law, or 2 - They suspect you may be breaking the law. Plain and Simple.

As Observer stated above, recording ...

Re: Fail to stop at red light for right turn, got disclosure

They have 6 months to issue new Highway Traffic Act charges, so since it's more than six months that should not be an issue. Now if there is some kind of Criminal Code charge that they could lay because of the video that is a different story. So assuming there is no Criminal Charges then you are fine.

And you should be able to pause the video at ...

Re: Fail to stop at red light for right turn, got disclosure

Since there is a stop line, yes, you are considered in the intersection after crossing that line. If there was no stop line, then it would have been the cross walk lines, and then you would have gotten charged. Just curious, do you drive a smart car, because thats the only car I can think of that fits between those two lines.

You have a pretty ...

It would depend, which ever car was in front would be determined to be going faster (physics), so if your GTI passed the other GTI, then of course you would get the ticket. If you were staying with the GTI (not passing, or not losing ground), it could be considered you pacing the other GTI, which in both cases, means you were doing 155km/h. What I ...

Can a TTC Bus Driver Be Ticketed?

Ok, So I'm pretty sure the answer is yes to this but this topic sparked some dispute at my workplace today. Every morning when I'm driving to work on Milner, approaching McCowan, there are three lanes. A left turn, a straight through, and a right turn lane. I constantly see a TTC bus, around 7:40 A.M. every morning making a Left Turn from the ...

If you stretch it out as long as possible it might be a good way to handle this so one ticket drops off your record before the conviction for the 2nd one is registered. I would make sure you fully understand what your insurers policy is as it is unusual if they only hold a conviction against you for a year.

There has to be some evidence pointing towards you hitting them (i.e damage on your vehicle). Let's just pretend that I wanted insurance money, so I claimed argyll hit me and drove off, and gave his plates, the police shouldn't charge him without some burden of proof.

On your summons date, just state you would like to review disclosure before you ...

If I'm not mistaken, Didn't you receive a Red Light - Fail to Stop in May? What was the outcome of that. I'm pretty sure if the prosecutor sees a conviction like that on your record, they wouldn't reduce the fine.

So just note that if you go to trial, they will amend the speed up to 81 in a 50 (31 over) as that is what the officers notes say.

Can they amend the speed back up? According to the computer generated notes (First Page of Disclosure) it said charged speed 79 and actual speed 79. Also on the ticket, it doesn't have a reduced code (R) on it. Just ...

Speeding 49 over = $359
Speeding 77 over = $750.75 + victim surcharge + court fees
Stunt Driving = minimum $2000, up to 2 year license suspension, possible 6 months in jail.

So it's either you pay the $359, or you could go to trial and risk getting charged minimum $3000, plus any suspension/jail they offer if you lose. I'd go in and see if they ...

I don't think the 11b would work if some adornments were at your "roomate's" fault. The 11b would only be at the fault of the prosecutor. If it was caused by the prosecutor, then an 11b should work.

Re: The idea of failing to provide DL

Not really. Criminal charges are very serious. I'd honestly rather get charged for every single violation in the HTA than 1 criminal offense. Criminal offenses show up on background checks, so applying for jobs would be affected, plus I know for certain criminal charges you can't leave the country with (I.e. Vacation, visiting family). I'd rather ...

Re: URGENT: London, ON voting on RED LIGHT CAMERAS

I wish red light tickets took pictures of the driver, and not the plate. Yes I know it has no insurance complications, but on 2 instances where my father got a red light ticket on a shared vehicle, no one wants to admit they ran the red. So my dad makes all of my siblings pay for the ticket, which I find is stupid.

I would suggest you not to lie in court. Perjury is a serious offense (Criminal) and frankly isn't worth losing a few points. It looks like the officer has a pretty air tight disclosure, mentioning your shirt colour, making you re-fasten your seat belt. I would honestly take any plea deal they offer.

Did you fax in your disclosure request? I haven't heard of a courthouse that accepts disclosure requests by email. Secondly, most of the time, they usually make you pick it up from the courthouse, so I'd send another request in and see if you get a response on that one.

The OP didn't upload his tickets. I did. What I was trying to show is that I believe that he is telling the truth behind the false charges. My headlights weren't out but I still got charged for it. Bear in mind, I was originally pulled for Stunt Driving, and he gave me a break, which is what I'm assuming happened to the OP.

The officer who charged me was really nice, so I really don't want to get him in trouble (hence blacking out almost every detail), however, I actually have proof of this happening. Check the time on both tickets and the handwriting as well.

JSherk,

I actually had a guy in a truck pull up beside me last night to tell me my brake light was out. Got home and got the girlfriend to sit in the car and press the brake for me. It just annoys the hell out of me when on dim lit parts on the 401 (between 410 and 427) and the 407 (east of Markham road), your casually cruising at 110-120, and then you have to slam your beaks because some idiot decides to drive in the middle lane, doing 80, with no lights on.
