Re: Proof for advanced green
So, your father had a red light, he is supposed to stop and complete the turn when it is safe to do. From what you are saying, there are 2 scenarios that happened.
1) The light was red for both sides, and the person blew through the red light (highly unlikely).
2)Your father had a red, and the other side had an advanced green (most likely).

From What I recall when I did my driving school approx 7 years ago, you were supposed to turn into the furthest right lane, and merge to the proper lane within 100m of turning. Second, the person making the left with the advanced green has the right of way, you are supposed to STOP and YIELD your right of way at a red light, and proceed when it ...

Also, if you have a G2 license, it's worth a shot to ask the prosecutor to reduce the speeding to a 29 over, because the 4 points will result in an immediate 30 day license suspension.

I thought insurance companies paid out for any medical claims involving an accident. Make sure you talk to your agent before filing a law suit, before you find a judge that will say go through your insurance.

For this type of ticket, I've seen 4 possible outcomes before.
Outcome 1) Prosecutor lowered the speed to 15km/h over. Total Fine of $52.50, 0 points.
Outcome 2) Prosecutor lowered the speed to 29km/h over. Total Fine of $138.75, 3 points.

No Insurance is a minimum $5000 each charge. X 2 will equal $10,000.
Drive - No License is a $260 charge. X "3 or 4" will equal $780 or $1040. Lets go with $780 for arguments sake.
For Invalid Plates, I'm going to assume its "Use Plates not Authorized for Vehicle". That's $140 per offense. X 3 would equal $420.

I will file a third request either today or tomorrow. My trial date is on the 19th of this month. If I can get an adjournment, will that strengthen my case for an 11b?

Once MTO or Police confiscate plates, those plates cannot be returned. You must go to the ministry and get new plates for the vehicle. Summons are summons because they have no set fine, based on severity, repeat offenders, etc, the fine will vary.

The sense I get, is there is a lot of pressure from other vested parties, politicians etc, to secure convictions for stunt at trial. So I would suspect the bar is quite high, higher than normal for sure, to get the charge dismissed.

Remember that anything 16 km/h or more over the posted speed limit has demerit points, although these don't affect your rates - just your driving record itself.
This is incorrect...
1 to 15 over is 0 demerits and considered a MINOR conviction by insurance which can cause your rates to go up.

What I find helps a lot, be honest, apologize, and acknowledge that you've done something wrong. I'm probably the last one to talk, but last year, I was pulled over for stunt driving 4 times. I think the most I was caught over was 96 km/h over (146 in a posted 50). I think the worst punishment I got was two lightbulb infractions. The other ...

Where did you stop your vehicle? If your tires were stopped before the white line, your good and should take it to trial, as you did not fail to stop. Even if you stop, you must stop before the white line, otherwise its not considered stopping (which is what I believe to have happened).

Not sure of the answer. I know the ministry knows if you have insurance or not. I was stopped about 4 months ago for driving with my high beams on (Honestly ...

The only reason I would believe a summons would be issued is if he was charged under 175(19) as the owner. Was the summons issued the same day, or more than 30 days but less than 6 months after the incident? If the summons was issued the same day then as above states, he had to receive a summons for another non-ticketable offense.

I got one of these last year April, and my court date is next month, so I don't know how backlogged they actually are. None the less, request disclosure, and hopefully they won't have it ready for your case (the situation which I'm in right now). That way, you'll be able to get an adjournment and that helps your case even more for an 11B.
