Re: Going 83km/h in 50km/h zone
See this:
128. (1) No person shall drive a motor vehicle at a rate of speed greater than,
(a) 50 kilometres per hour on a highway within a local municipality or within a built-up area;
(b) despite clause (a), 80 kilometres per hour on a highway, not within a built-up area , that is within a local municipality that had the status of a township ...

Re: Proof for advanced green
So, your father had a red light, he is supposed to stop and complete the turn when it is safe to do. From what you are saying, there are 2 scenarios that happened.
1) The light was red for both sides, and the person blew through the red light (highly unlikely).
2)Your father had a red, and the other side had an advanced green (most likely).
Based ...

Re: Is a person riding a bicycle a pedestrian?
She was charged with:
140. (1) When a pedestrian is crossing on the roadway within a pedestrian crossover, the driver of a vehicle approaching the crossover,
(a) shall stop before entering the crossover;
So a crossover defined under the HTA is defined here (https://www.ontario.ca/laws/regulation/150402#BK0). Most likely, it was a 4 way stop which ...

Re: Questions Regarding Right Turns
From What I recall when I did my driving school approx 7 years ago, you were supposed to turn into the furthest right lane, and merge to the proper lane within 100m of turning. Second, the person making the left with the advanced green has the right of way, you are supposed to STOP and YIELD your right of way at a red light, and proceed when it ...

Also, if you have a G2 license, it's worth a shot to ask the prosecutor to reduce the speeding to a 29 over, because the 4 points will result in an immediate 30 day license suspension.

Re: Cautioned for careless driving
I thought insurance companies paid out for any medical claims involving an accident. Make sure you talk to your agent before filing a law suit, before you find a judge that will say go through your insurance.

Re: First ticket ever, 38 km/h over on the 401
For this type of ticket, I've seen 4 possible outcomes before.
Outcome 1) Prosecutor lowered the speed to 15km/h over. Total Fine of $52.50, 0 points.
Outcome 2) Prosecutor lowered the speed to 29km/h over. Total Fine of $138.75, 3 points.
Outcome 3) Prosecutor changed the charge to Disobey Sign. Total Fine of $110, 2 points.

Re: Need help
No Insurance is a minimum $5000 each charge. X 2 will equal $10,000.
Drive - No License is a $260 charge. X "3 or 4" will equal $780 or $1040. Lets go with $780 for arguments sake.
For Invalid Plates, I'm going to assume its "Use Plates not Authorized for Vehicle". That's $140 per offense. X 3 would equal $420.

Re: Ticketed For Parking in a Handicap Spot
So I requested disclosure on Feb. 25th. Didn't receive anything. Filed a second disclosure request on April 5th, and still haven't received anything. I will file a third request either today or tomorrow. My trial date is on the 19th of this month. If I can get an adjournment, will that strengthen my case for an 11b?
