Re: Is this legal?

I have all the love in the world for the police officers, I just wish that their political masters wouldn't take a highly skilled, specially selected, well paid civil servant and make them go after very minor offences (rolling stops, 10 over etc.), especially when they could be directed to spending that time interacting with our youth, and making ...

Re: Sticker expired, court this week 2 fast questions please

Even though this technically should NOT count as a moving violation (you could get this ticket parked on street)

First of all that isn't correct. The charge is "drive motor vehicle- no currently validated permit" and therefore doesn't apply to parked vehicles.

Also, it is not a "moving" violation and there are no demerit points attached... with ...

Re: Motor Vehicle Involved (N) Checked - When to bring up.

- I'm not sure how much more clear to make it to you... you've already been explained that this is not a fatal flaw and for that reason a question like 'how can I be speeding if motor vehicle is checked as NO' is easily overlooked by the courts.

Re: Is this legal?

If you notice a speed trap and you really just don't like the police - is it against the law - like obstruction of justice - to point out to others that there is a speed trap up ahead?

Can you circle around and stop somewhere ahead of the trap and hold a sign saying cops ahead or something?

-Just curious.

I am not sure where your dislike for ...

.... okay well you seem to have great difficulty replicating the information on the ticket onto the message board here so why don't you go ahead and scan an image of the ticket and post it to lay to rest all the confusion you've created while the nice people here try to help you.

If you read through a few of the threads at this board, they explain to select the option to speak with the prosecutor who will generally offer you a lower fine in exchange for a guilty plea.

Be advised that there are no demerit points for camera red-light tickets.

No there will be no record of it

Ops

Not necessarily entirely true... correct, there will be no record of it on your driver's licence or abstract or anything like that, but there may be a police record containing all of your information as to why you were stopped and the outcome of the investigation. These records are held by the police and ...

Re: Question: Expired Stickers on private property.

Yeah.. the offence is 'drive motor vehicle without currently validated permit', so if there is no driving evidence (driving meaning on a highway and not a public road), then the charge doesn't apply.

Re: Question: Expired Stickers on private property.

1) You don't have to be stopped on a public road, however the officer does need some evidence that you were driving with the expired tags on a public road.

2) the officer told you to get in your car for his safety- have some respect and comply.

3) Yes he is allowed to carry out traffic stops onto private property from the roadway. Imagine if ...

generally yes allowances are made... explain you applied for disclosure at the earliest possible time (you didn't delay applying for the disclosure which would lead to delaying the court), and only recently received it and you have not had enough time to review it properly.

Hey ..

Couple questions: How come they didn't send the discolure to my address and are asking me to pick it up? and can I get an adjournment in this matter. I honestly don't think I have the time to pick up the disclosure in the coming days and come up with a defense if the cop is present.

Thanks for any help.

If you're coming here and asking us for help when there is 4 weeks from your court date, I'll assume you don't have a lawyer.

So, quite simply, the best advice I can give you: GET A LAWYER. You think fools on the internet can help you with this? These are criminal charges man. Give your head a shake.

It's funny... I rarely if ever write this ticket (the only time I do is when the pedestrian nearly gets themself killed)... so I don't have much experience with convictions/testifying to this charge.

1. Dangerous Driving is not a ticket, it's a Criminal offence for which you have been arrested. This "ticket" you refer to might be the Form 9 or Form 10 you were served as a result of being arrested and charged.

Re: 111 in 80 (reduced to 95) - on a hill, I have a dash-cam

First: if your car 'shakes' when you go faster than 100km, and is clearly a vehicle in tip-top shape, I somehow doubt your speedometer is more accurate than the laser or radar the officer was operating.

Second: So?

Third: So? They didn't get stopped, you did.

Fourth: How is it clear he lost sight of you?

The video will not be relevant to the ...

I can tell you there are no demerit points involved. If you plan on contesting the ticket, you might want to try and think of some sort of defence.

Go to your scheduled date found on your court summons (Form 104). Show them receipts and proof that you fixed these issues as soon as you possibly could. Pay for and bring your driver's abstract. You'll more than likely be offered a 'Drive motor vehicle - no licence' 32(1) ticket with a $500 fine, as opposed to the $1000 and/or licence suspension ...
