Everyone makes a u-turn there. It's a total drag to have to drive around. But with the curves, there's a visibility issue and you don't see the cop coming around the bend until it's too late.

You can be speeding and be charged under s. 128 instead of 172. They are different charges. How do you tell the difference? Do you still have your vehicle?

think the "new" is just a courtesy for immediate residents of that street.

What would be the difference if any of us drove to Thunder Bay and we did not see a stop sign that had been there for 10years?

You basically have two options: plead or fight. Like Bookm suggests, you can try going to a first attendance meeting and negotiating a lower charge. You should be able to get this one down to 15km/h or less and avoid demerit points.

If that fails, then mount your defence. Request disclosure and prepare for battle.

Bookm what's O. Reg 246/03? Is that just an older version of the current reg?

O. Reg 615 covers stop signs.

Make sure you request an interpretor when you request a trial. You have a right to one under s. 14 of the Charter.

Also print off the weather report for that day to use at trial. If there was low visibility, the less likely the cop was able to see you stop. And your version of events will be more credible.

I was thinking of this section as well. The interesting wording is the JP "shall hold a hearing" which to me means he'll ask the cop questions in response to the defence statement. This in effect means the cop is testifying.

I'm seriously thinking about abstaining. We've got three great candidates and frankly I would be happy with any and all of them.

You can be more aggressive with your disclosure requests. You can ask for a list of witnesses, will say statements, even contact information of all witnesses prior to trial.

Unless the officer is an accident reconstruction expert, the Crown will need at least one witness to testify about what happened. The accident report does not carry much ...

It's fairly straightforward to do. You have to file your appeal within 15 days. Then request a transcript. In Toronto, you then wait a year and shell out about $80 before you get it (3 copies).

When it's finally ready, you submit the transcript to the prosecutor and the clerk of the court. They'll only schedule a trial after getting the ...

The fax numbers I have are: 416-338-7703 (Prosecutor) and 416-338-7700 (Court House). Just double check my numbers especially for the clerk of the court. You don't want to blow it over a simple mistake.

Congratulations! No conviction is a win no matter how you get it.

Usually they schedule defendants to appear 30 mins before court starts. That way they can poll the court to see how many are contesting the charge and how many will cave. They also have time to do some last minute negotiating.

Hindsight is 20/20. A stay application 15 days in advance of trial would have stopped their disclosure in its tracks.

The amount of time it took them to process your disclosure request is long but not unusual (Toronto takes a minimum of 8 weeks).

The amount of time to go to trial is just over 10 months which is not unreasonably long.

I've got to dissent on this one. S 159.1(1) is slow down and S 159.1(2) is slow down and move over. Slow down is not an option, it's mandatory. At 90 km/h, this is not a sufficient reduction to the posted limit. It may have been a significant reduction to what you were driving but that doesn't matter - you were speeding before.

They can't raise the ticket back up to the original speed limit. The insurance implication as Racer suggested is what you need to worry about. The cost of fighting the ticket (time off work) may not be worth fighting the charge.

p.s. Don't you need a GST registration number before you can charge GST?
