I have driven on the autobahn and the one thing that is absolutely clear is that it is unforgiving in the way it is designed.

In Ontario several kms before an exit sign we get a warning sign that it's coming up. We might get two more warnings before finally coming to the huge exit sign.

Parking Ticket Leads to Computer Virus

Hackers have discovered a new way of duping users onto fraudulent websites: fake parking tickets.

Cars in the US had traffic violation tickets placed on the windscreen, which then directed users to a website.

The website claimed to have photos of the alleged parking violation, but then tricks users into downloading a virus.

Careless driving is one of the most severe charges under the HTA and also one of the hardest to prove. The mere fact you were in an accident shouldn't trigger the charge. It should be a marked departure from due care and attention.

Usually u-turn signs don't actually have any words on them so there won't be a "language" issue.

You were charged under s.182 not s.143 (u-turns) which means the sign was erected by municipal by-law as opposed to a "natural" no u-turn under s. 143.

- So disclosure should produce the certified copy of the by-law, if not, argue improper disclosure ...

Or everyone will start driving around with calculators. And that would create another driver distraction ban: NO DRIVING WITH CALCULATORS! 6 pt penalty or maybe 2x3pt penalties (since you've got the calculator handy)

I'm not sure what "rounded for 1 year" means. Whether the Crown or the police have it, it is the Crown's duty to disclose it to you. I ain't no English professor (hehe), but I believe the " By " being on the left of the comma restricts subsections i to iv to "[C]" only. If the " By " had been on the right of the comma, [A], AND [C] would have been associated to subsections i to iv.

Naw... Reflections nailed it! The word "or" breaks this sentence into 3 separate possibilities for conviction. If "and" had been used instead, THEN the "endangerment" portion would be required for all of it.

"Marked Departure" of speed is in the definition of "Race" or "Contest", not "Stunt".

Actually the word "by" is what's at play here ...

TC...speaking of face value of a PON. What about the signature? I have two ways of thinking on this.
1) Sign the top copy, identical signature is complete thru each layer of the PON, thus all are original and identical

I'm with Bear on this one. Doesn't meet the definition of stunt. The way it's written you must drive at a marked departure from the lawful rate of speed and cause any of the following:
  • lack or attention
  • lack of consideration
  • endangerment
There was no (excessive) speeding. Doesn't meet "the stunt" requirement.

A missing signature is a fatal error as my site states. Or if there is nothing to identify the officer. BUT if it's an electronic document then the printed name is the signature and it's valid: ONTARIO REGULATION 497/94 - ELECTRONIC DOCUMENTS

So without any evidence to confirm the visual observation...what do we have? no evidence!

What I don't get is these trained OPP officers can't tell the difference between 180 km/h and 100km/h as they're driving? If you drive through a school zone, can you tell if you're going 40km/h or 120km/h without looking at the speedometer?

Ontario has reciprocal agreements with other provinces. You get a ticket there, it comes on your record here. If that ticket is still on your record, this would have implications. MTO keeps the conviction on your record for 3 years, demerit pts for 2 years. Insurance companies keep records up to 6 years.

Always check the intend to challenge box ...

I heard where the cop can still make some changes to the ticket after the fact, but not too sure on how that works.
That's a huge no no and will get the ticket tossed quick.
