Re: Careless Driving - PI so mandatory charge?

Just a note, both officers will have to be present to testify.

You definitely do not need a lawyer for this. Paralegals advising you were right about not needing lawyer. A traffic ticket paralegal is a professional who specializes in the OHTA law. Lawyers are those who deal with criminal law - ie DUI.

As for mail-in submission, I think you need to download Form 18A. Seems the closest one to description.

So, basically, you completed a turn in 1.5 seconds. You might argue that you did stop for a split second and then proceeded to make the right turn. But I am fairly certain your car needs to be in that second picture.

Why cancel an already scheduled court date? By letting it happen you still can plead guilty with an explanation at worst plus have a chance of winning if the cop does not show up (unless you don't want to spend time to take that chance)

The cop might show up and mess up the plans a bit. The stakes are higher. If your insurance can let you have ...

This also gives you enough time to find a new insurance provider. 3 minor tickets = insurance suspension  ??? Having an insurance suspension (or a kick-off) is usually as bad as a serious charge like "Stunt ...

Re: Slid into a car at intersection - Careless Driving.

With a charge like careless driving, I'd recommend discussing this with a paralegal. If he bumped or broadsided a car that was stopped while he made the turn, particularly with rainy road conditions, a careless driving charge is not surprising. The consequences of a careless driving conviction are quite severe, particularly with respect to ...

Re: Driver failing to ensure toddler passenger is secured as pre

They should mail it to you, unless you provided them with a fax number. If you did then they will probably try to fax over the disclosure. If the fax had failed, you probably need to pick up the disclosure yourself.

However, you do NOT want to receive disclosure. Not receiving disclosure means that you can win the ticket on that fact alone. If ...

Re: Typical fine for studded tires in Southern Ontario?

If you accept the ~4% accident reduction attributable to stud use in the 10-year-old meta-study linked below, and refer to the Ministry of Transport's 2006 accident statistics, you conclude that 737 fewer people would sustain a personal injury every year if everybody used studs. (I considered winter to be from November to March inclusive). If you ...

You might. However, it might be a good idea to look at other possible venues of defence. Send in your ticket with option 3 checked off, check "Officer present" as well, then ask for disclosure, make sure that you request a copy of the by-law applicable. It is always better to be prepared more than you really need to.

Re: Ontario's Demerit Points System and What it me

Besides the possible suspension of ones license, traffic tickets that contain demerit points have a direct impact on ones financial situation because the demerit points directly affect insurance rates.

I wouldn't say they directly affect insurance rates. Insurance companies do tend to treat higher demerit point convictions more seriously, but ...

As a "statutory" Court (a Court created by statute), the Ontario Court of Justice has that jurisdiction which is specifically given to it by the laws of Ontario and Canada. In broad terms, the justices of the peace of the Court have jurisdiction with respect to provincial offences, bail hearings and search warrants. Judges of the Court deal with a ...

2. No. The police are not required to tell you how many points there are with your charge at all.
