Re: Calibration discrepancy or sloppy writing - viable defen

nor can a speedometer calibrate a radar

The only time this would be a true "calibration" is if the officer subsequently started tinkering with the radar after there was a discrepancy with the speedometer reading. .

you got it backwards....we carry the multi-tool so back in the old day we put on a set of coveralls, go under the car ...

Re: NEED HELP - Stunt charge - Some initial questions please

HTA 172 (1) is the proper section for the offence of a stunt / race

The Oreg you refer to is simply clarifing what the "definition" of a stunt / race is

Re: Calibration discrepancy or sloppy writing - viable defen

just to clarify for you it is not a "calibration" section.

It is the speedometer comparison section, which is the correlation between the speedometer and the reading on the "patrol" area of the radar

Just to clarify for you, whenever you compare the reading of a measuring device to a reference you trust for the purpose of adjusting the scale or ...

Re: Failed to wear belt with medical reason: still ticketed

Hopefully your doctor also added in the requirement of the HTA that a start and end date be on the medical certificate.

Also recommend during an annual check to get an updated certificate!

Re: invalid permit

This is the offence section:
HTA
7. (1) No person shall drive a motor vehicle on a highway unless,
(a) there exists a currently validated permit for the vehicle

This is the regulation which stipulates where the validation must be:
HTA OREG 628
6. A permit for a motor vehicle shall be validated by means of evidence of validation provided by the ...

It should be speedy, however, tighten up the other end too...either respond within 15 days or be guilty.

think proving it is rather easy....rarely do those texters ever look anywhere other than a quick glance up and forward, they wont be seeing a cruiser or even a transport driving next to them the last 5 minutes or so

Re: Drive hand held communication device

The problem is exactly what Squishy said, the HTA law says if the cell phone is "mounted" to the vehicle in some form (you can buy one of the AC/Heat ventilation mounts from Walmart for 20 bucks) you can press as many buttons on it as you wish, same goes for the GPS mounted units..
Not quite....there is a Excemption to use the "buttons" and is ...

Re: Drinking and driving laws

1) The law states that drivers with BAC level 0.08 or higher may be arrested and charged for Over 80. This is all fair and straightforward. Within the last couple years new legislation has been introduced where drivers found to have between 0.05 and 0.08 BAC levels may have their drivers licence suspended and their vehicle impounded. This would be ...

Re: 122 in a 90, received some disclosure need help decipher

What about accuracy of speed if adequate testing was not performed at distance of over 500m? There seems to be plenty of case law to support that even where the driver was the sole vehicle on the road.

500m is a very long distance.....and it could be problematic.
routinely target vehicles around 1km with ease....RI can confirm that too!
