EDIT: Okay, I see that 150(1)(b) only requires sufficient width for two or more lines of traffic, which a 400-series highway still meets without counting the shoulder. But doesn't 150(2) trump 150(1)(b) in that you still can't drive off the roadway?
Way I read it 150(1)(b) also has to have met 150(1)(a) as well.

you asked if it was proper offence and I answered yes....nothing biased at all there!
It is one of the few B&W offences in the HTA.
and couple other things that might come to mind...
1) If police would let the person continue without a licence and then for some reason there is a collision....I certainly don't want to be on the end of a civil suit ...

Once your licence expires you no longer have a licence to drive, therefore you are driving without a licence.

Or were there trucks in the right lane and the officer passed them on the shoulder? In the latter case, it would be "passing off roadway" (s. 150 (2)) but I'm pretty sure an officer can do so if on a call, lights or not.

Ofcourse, the throttle response is different than on my Jetta with a "mighty" 75hp diesel engine. does not sound like any violation at all. Sounds more like an inexperienced officer(s) or not knowing what the sections mean. If one doesn't know the section, how can one issue an offence?

It's possible, but not highly likely. There are plenty of people who still do 50+ over the limit, so they don't really need to manufacture charges. With that being said, out of about 10 hta offences that I've been charged with over the years, one was a complete fabrication by the constable.

Now in the case of a multi-lane highway - what if the person in the left lane was going, say, just 5 km/h slower than traffic to the right? Cars behind them wouldn't be able to wait their turn, as the lead car isn't even passing vehicles. Could they be charged under S. 172, or would it be 147 or 148 instead?

think the only thing you might see is the "impoundment" portion. I can see the licence suspension remaining in affect, it is similiar based as the 90 day ADLS which has been around for years.
