Re: O.P.P criuser impounded under 172

You ever notice that some people have no problem completely blocking the isle with their cart at the local supermarket, while they wander around looking for that special brand of bathroom spray they like so much?

You mean you don't help them and "add" an extra grocery item or two to the "abandoned cart"?? Would love to see their faces at check ...

Re: Expired drivers License

Besides as many on this forum can attest, I do not chatise people on here. I try to bring a perspective from the other side which 99% of people do not know at all.

Absolutely. And as I said before, your input is very much appreciated, and you've been on this forum much longer than I have..

Like to thank you RI and FiReSTaRT. I have just over ...

Re: O.P.P criuser impounded under 172

EDIT: Okay, I see that 150(1)(b) only requires sufficient width for two or more lines of traffic, which a 400-series highway still meets without counting the shoulder. But doesn't 150(2) trump 150(1)(b) in that you still can't drive off the roadway?
Way I read it 150(1)(b) also has to have met 150(1)(a) as well.

The 141(6), seems to apply that ...

Re: Expired drivers License

you asked if it was proper offence and I answered yes....nothing biased at all there!

It is one of the few B&W offences in the HTA.

and couple other things that might come to mind...
1) If police would let the person continue without a licence and then for some reason there is a collision....I certainly don't want to be on the end of a civil suit ...

Re: O.P.P criuser impounded under 172

Sheesh, now I had to start looking this stuff up

Definition of "roadway" means the part of the highway that is improved, designed or ordinarily used for vehicular traffic, but DOES NOT include the shoulder

Passing to right of vehicle
150. (1) The driver of a motor vehicle may overtake and pass to the right of another vehicle only where ...

Re: Expired drivers License

Once your licence expires you no longer have a licence to drive, therefore you are driving without a licence.

A little blessing in it all.....I have yet to hear of an insurance company covering any costs of a collision for a driver with an expired licence as they don't have a licence to drive. I have seen coverage if you are hit by an unlicenced ...

Other - patrol stuff

Moved this quote over so as not to get the other off-topic..
Hwybear are you west of london where your unit patrolls do they have highway safety divisions there?

Yes and No.....yes I'm confused also. We were once the "401 Corridor Safety Team", then to HEAT (Highway Enforcement Action Team), then to HSD (Highway Safety Division), now just back ...

Re: O.P.P criuser impounded under 172

Or were there trucks in the right lane and the officer passed them on the shoulder? In the latter case, it would be "passing off roadway" (s. 150 (2)) but I'm pretty sure an officer can do so if on a call, lights or not.

For anyone, Sect 150 does not apply either on a "paved" shoulder! Fail to drive in a marked lane does...FYI

Re: New Stunting Laws - Is there any hope?

Thanks Bear. However, you raised another possible concern with 172. For work, I get to drive a p/u truck on occasion. Ofcourse, the throttle response is different than on my Jetta with a "mighty" 75hp diesel engine. When the truck isn't loaded and the pavement is wet, the tires sometimes do slip just enough to make a quick chirp. While that falls ...

Re: proof of speeding 50km/h over posted

does not sound like any violation at all. Sounds more like an inexperienced officer(s) or not knowing what the sections mean. If one doesn't know the section, how can one issue an offence?

That would be like me trying to enforce:
Trap specially protected invertebrate under the Fish and Wildlife Conservation Act.

Re: proof of speeding 50km/h over posted

It's possible, but not highly likely. There are plenty of people who still do 50+ over the limit, so they don't really need to manufacture charges. With that being said, out of about 10 hta offences that I've been charged with over the years, one was a complete fabrication by the constable.

I have never know an officer to fabricate an offence ...

Re: proof of speeding 50km/h over posted

If you ask, at the time of the offence, does the officer have to provide the offender with proof that they were going 50km/h over the posted speed limit? (I think I know the answer to this already)

There is no requirement to show the person anything. There is no requirement for a reading to be "locked" in either.
If the driver ask to see the ...

Re: New Stunting Laws - Is there any hope?

Bear, this question is directed specifically at you, as a member of the law enforcement community: While I am aware of the intent of the law, have you ever heard of it being wrongfully applied in this context?

I had my own MC, but sold it. I now have the priviledge of riding while working :D

I have never seen or heard of any of the 172 being ...
