There has to be some evidence pointing towards you hitting them (i.e damage on your vehicle).
The witnesses are part of the evidence. There doesn't need to be a "bloody glove". Anyone is capable of clipping a pedestrian without having any visible damage on the vehicle. The "no damage" defense is not a theory i'd put all my marbles into.

Now I know I waited too long to request disclosure but can anyone help me out with my options. I have a court date in early march and have nothing. This is a great ticket to use to learn about how the court system works. So even if you go to trial and lose, it still will not be on your driving record and will not affect your insurance.

I understood that Ontario's red light law is "permissive", meaning if you are already in the intersection when it turns red, you're OK (as opposed to someone's comment above saying you're already guilty if you run an amber). Thanks for suggestions. I requested the trial about a week after the ticket was issued. Looks like my best case scenario is speaking with prosecutor before trial to get this ticket reduced.

It was going around a bend and there was a car in front of me. But it's pretty much his word.
Once you start talking about bends in the road you put yourself in a vulnerable position. Going around a bend will only have your speed read out slower than it was, so if they follow the officers notes, it kind of makes you look worse than it already is ...

Are you saying the officer got the speed of the wrong vehicle? The notes mention you were the closest vehicle to him and that you were pulling away from the traffic behind you (traffic 100m behind). Notes are pretty good. Doesn't sound like that argument ...

The difference between a careless driving charge and whatever reduced charge is likely to be pretty big.

The logical thing to do would be to slow down, pull to the side as much as possible, and try to let the car behind you pass, not continue speeding more and more. They are going to bring up this fact during your trial.
