Re: Disobery Stop Sign - Fail To Stop issued with hospital/CAMH campus

Mostly correct but not always the case. Larger malls, hospitals, campuses, etc may have an agreement that covers the main roads going through the property so they're classified as highways.

Doesn't hurt to double check though.

Re: Disobery Stop Sign - Fail To Stop issued with hospital/CAMH campus

I don't think "xcopper" or the equivalent is going to benefit you all too much in your particular scenario. If you're asking whether or not you can just plead mercy and hope they decide to drop the ticket, it's not going to happen. Sometimes they can offer you a plea deal for a lesser charge. I don't believe there is an opportunity for a reduction ...

Re: Disobery Stop Sign - Fail To Stop issued with hospital/CAMH campus

You don't have to stop for 3 seconds. You just have to come to a complete stop. That means your tires should at some point come to a standstill, at which point you can immediately proceed as long as it's safe to do so.

I'm not sure how far you want to go with this ticket. I mean, that's up to you.

Here's the bare minimum you can do. If you've ...

Re: red light turn - red light camera in the intersection

You need to hit a certain criteria before a red light camera will activate.

They work based on speed. I don't know the exact number or if it's the same with every camera, but it's something like 20-30+. Simply creeping forward will not set if off.

I wouldn't expect a ticket in the mail.

Re: Red light camera flashed 2 times while turning left

1) Red light cameras need a certain speed threshold to activate. eg 25km+
2) Red light camera wont active if you're already in the intersection. They will take a photo of your vehicle behind the line while also showing the red light. It will take another picture when you're in the intersection to prove you crossed the line while red.
3) Red light ...

Re: Fail To Stop - Amber Light and Fail to Have insurance Card

Could I play the excuse of having no winter tires? It was -10 degrees that day.

Ultimately, it would your responsibility to drive according to the conditions. Whether it's -10°C and snowing or 30°C and raining, it's up to the driver to accommodate his or her driving.

Could I say I had cars behind me and did not felt safe stopping?

Re: Officer says 35 over, my dash cam says I was no more than 11 over

Speeding is what they call an "absolute liability" offense. It's important to know that.

Basically what that means is that you either speeding or you weren't.

Your defense would have to be "I was not speeding." There's no wiggle room here. It can't be "I was speeding but..."

By suggesting you provide video of yourself speeding, whether it's ...

Re: Distracted driving - I'm fighting - but I never got a court date

Theres cases won against the court because having a cellphone holder or making sure it fits in your cupholder is not enforceable.

I've personally never heard of such a ruling. I'd like to read it, though.

The most high profile case probably involves Khojasteh Kazemi. Kazemi had abrupted stopped at a stop sign when her phone fell to the floor ...

Re: Licence suspended for 6 months due to medical report

In Ontario, there's a list of conditions where a doctor is legally required to report you to the Ministry of Transportation. Issues with alcohol are one of those. It's quite common for an individual to go to a clinic or hospital for alcohol related issues and find they've been reported to the ministry.

Can you appeal? Yes, you have to file an ...

Re: Distracted driving - I'm fighting - but I never got a court date

I'd agree with Markus.

The Highway Traffic Act also covers this in its exemptions for handheld devices.

There are exemptions for pressing buttons (make call, answer call, end call). You can do so if the device is secure or mounted so it doesn't move and you have to be able to see it quickly at a glance. Otherwise, you can't touch your phone ...

Re: Distracted driving - I'm fighting - but I never got a court date

There are limits on how long an officer has to charge you for an offence and how long the officer has to file.

You've already been charged and the ticket has been filed, so any argument for an unreasonable delay would have to be made in a courtroom under a charter application (11b). Under regular circumstances, a case for could be made at the 18 ...

There's a certain list of conditions that doctors in Ontario are legally required to report to the ministry of transportation. Heart conditions are one.

I'm not sure where you fall because if they were going to report you, they probably would have done so already. But I guess just because one doctor hasn't, doesn't mean another wont as you ...

I am in the same boat, I was at 151, and the officer reduced to 149. Did you paid or contested the ticket? Did your insurance got affected right away? and yes then how much?

Insurance providers issue a surcharge percentage based on that persons rate. Whatever this person ends up paying will be based on their own particular situation.
