so the biggest thing about this ticket is the huge fine amount..and no real consequences as far as insurance and drivers abstract goes...correct?

They don't know who was driving the vehicle. Your average tickets when issued are issued against a license, hence why it'll show up on your abstract. Since they do not know (or care) who was driving ...

Based on just your version of the events in a trial? Zero.

There is no set distance between vehicles because there are too many variables to consider. Weather, road conditions, brakes, vehicle weight, tires, and the list goes on and on.

umm 100% ? If you pay the fine, you're admitting guilt. It's not going to slip in between some imaginary cracks.

I was curious if there is any way that demerit points can be reduced or taken off of one's record after the tickets have been paid. I know in Alberta one can take a 'safe driving course' after a certain amount of time with a clean record and get demerit points taken off. Is there any such thing in Ontario? They aren't going to care about your clean record. It may keep them from raising the fine, but it's not going to make the charge go away.

Your summons is just a court appearance. It's not your trial.

Am I better off trying to negotiate the charge down to 75/km/hr in a 60km zone.....OR

- It's not a garage sale. You can pretty much take what they offer you or you can continue on with a trial.
- They are not going to offer you a completely unrelated charge when there's still room to reduce your speed ...

Just so you are aware, any conviction over 4 points is a violation for a Novice Driver.

First occurrence is a 30 day suspension.
Second occurrence is a 90 day suspension.
Third occurrence and your license will be cancelled. No credit for time or money. You start from G1 and go through the whole process again.

Yes, you can still plead guilty. They may or may not offer you a reduced charge. They'll do so in return for a guilty plea and avoiding a time consuming trial.

I'm not worried about the fine, I just don't want the points because it is my first ticket and It will affect my insurance a lot since I am a student. Is there any way I can talk to the officer and get my points deducted? I chose option 2 on the ticket for early resolution.

Would they not offer a better deal if there is no tickets on my record period? or does this really make no difference at all? The prosecutor mentioned they would review my driving record to help make a decision.

The offer isn't going to get any better than 15km and no points. They'll ask you about your record just to make sure you're not a moron ...

I am not sure what you think will be in the disclosure package. No insurance is a reverse onus charge and therefore the crown does not have to prove that there was no insurance your son has to prove that there was at the time of the stop. Disclosure can be a simple as a page of notes with his info and no insurance written.

It doesn't work like that.

The penalty is what it is. You can't be convicted and start negotiating some sort of deal. If you are convicted of going through a stop sign, you are going to get 3 points no matter what. You don't get the luxury of having a trial and then bargaining some sort of smaller charge. You can't have your cake and eat it too ...

You would need to request a trial and request disclosure to see what the evidence is against you. It'll list the original speed if the ticket has been reduced.

If your charge has been reduced from 50+, I wouldn't count on catching anymore breaks.

If you go all the way to trial, you will see your charges amended your real speed. Probably something ...
