- Is it possible to mail in my request to go to trial or do I have to go in person (I live 60 km from Ottawa so Id rather not have to drive in).
Yes, you can mail it in. Just fill in the blank space if you need an interpreter, check whatever boxes, and leave your signature. It's all there.

Re: hand-held device
It's not. You need to be legally parked. If you can't get out of your car and leave it there legally, you can't use your phone.rooferrick wrote:I recently got a ticket for drive-hand-held communication device. I was stopped at a red light the entire time I was on the phone (about 10 seconds). is this a viable defence?

Re: Roll Cages & Helmets?
This is a drag up from the past, but I thought I would leave some input here.
Driving a car on the street with a rollcage and without a helmet could potentially be dangerous. If you got rear ended and bounced your head off the main hoop, you'd most likely bust it wide open.
I am saying this only because I'm a bigger guy and I would most ...

and if the poor visibility and weather conditions will help my case.
Thanks!
It will not help your case. Poor visibility/conditions is not an excuse to endanger people's lives by blindly accelerating over sidewalks and into traffic. If the conditions aren't suitable, don't drive. If you need someone to spot you while you get back on the road ...

Re: Went threw Red Light Camera last night, couple of Questi
1) Looking at Peels website they claim to have 12 Cameras "active" in Mississauga dated November 2012 (although clicking on the google map shows 21), along Derry road it has Red light cameras listed on Mavis, Tomken, Airport, Rexwood and Winston Churchill but not Hurontario. I saw on an older map dated August 2011 it had one listed for this ...

Re: Are stunt driving penalties unconstitutional?
You aren't the only one to raise questions about the way people are charged with regard to street racing. It's been a hot topic throughout the years and there's quite a bit of case law regarding this topic.
Rulings have gone back and forth for each side. As it stands now, it's perfectly legal to impound a vehicle on the spot. Although if it's any ...

Re: Do tickets on a out of province license affect insurance
By my logic, tickets from other provinces should not count towards a higher insurance as there is no memorandum of understanding (that I know of) that state that the Manitoba Highway Traffic Act is equivalent to the Ontario Highway Traffic Act.
Provinces along with many U.S. States share a Reciprocal Agreement. Your ticket in another province or ...

Re: Sticker expired, court this week 2 fast questions please
This whole "the officer is not going to show up" thing is completely overrated. He is going to be there almost always. He cannot simply just not show up.
You won't know if the officer is there unless he is standing next to you and you can pick him out of the other officers who may also be in the court room. Sometimes they sit around in the court ...

Am I a terrible human being and there is no excuse whatsoever what I have just done, or does it make any sense for me to go to court and try to fight the ticket, with my confusion about the new set of lights being my defense?

My court date is tomorrow. Is there an option to request to view the evidence before the trial begins?
Thanks,
You've had plenty of time to request disclosure since you received your notice of trial. Your court date isn't the time to start asking for disclosure.

Re: Distracted by sudden snow conditions! Any Hope for me?
As already stated, speeding is an absolute liability. What that means is you are either speeding or you aren't. They aren't interested in hearing excuses to why you were speeding.
Even if they could take into consideration your current defense, in my opinion, it's absolutely terrible.
- The conditions were so bad that you actually ended up going ...

Re: 80km/h in a 50km/h zone
Speeding is an absolute liability offense. What that means is you were either speeding or you weren't. Your defense has to be " I was not speeding and here's why...". Saying you were doing 78 and not 80 is not a defense for an absolute liability offense. All you're telling the court is "I'm guilty and please ignore everything i'm about to say".
