I also think that by not allowing someone to not leave a parking spot and risk a FINE, could be Unconstitutional in some way..Dont laugh..Now by far I am not in any way knowledgeable in that field, so this is just my opinion, I feel that it seems like a very rough stance and seems like a Detention. I would try to argue it seems like Detention ...

Personally I would take the chance for round two, I assume its free and the most you would end up with having to pay the ticket?

But if you are seen in a video threatening, that could be a different situation, maybe attempted murder or attempted vehicular manslaughter?

Well just because you can, doesnt mean you should right. Like just think if two skinny cars or smart car types tried to pull that stunt? Frankly I would call it a Stunt and it shouldnt be legal in my opinion. If it is or not I dont know.

Newly licensed Paralegal in Ontario (since May 2018) fighting traffic tickets in Windsor, Ontario area! I've come here for the discussion and to get insight on the HTA with us common people! My belief is you need to see the law from both sides in order to properly defend clients!

Should this driver not have been charged with careless driving since she caused bodily harm? Its not as if I was jaywalking - I was crossing at a green light.
That is scary and sorry that happened to you! Could be different factors the police looked into when charging with careless driving so its hard to say why they didnt or did from a forums ...

it sounds like the holder of the permit must be at the parking spot . :( :(
The person must be with you. But whos to say you didnt leave him there to drive to McDonalds for a coffee then come back and re-park there?

So you are wondering if writing the incorrect ACT but correct SECTION could be considered a fatal error?

That wouldnt be clear to me, why would I stop just because there is a parked school bus on the side of the road? Doesnt add up. Its the bus drivers duty to make sure the bus is safely stopped before also just displaying the stop sign. You can stop for no reason, I wouldnt.
