Re: Determining Original Speed When Code "R" Indicated

FYI I'm pretty sure 29 over is the maximum speed that can be issued on regular ticket for a community safety zone. 30+ over has no set fine and requires a summons.

Yes and no. The two sections really cover different types of offences. And 150(3) goes on to state that 150(2) doesn't apply to paved shoulders, where most of the idiotic passing takes place.

Toronto to allow e-mail resolution of some parking tickets

Toronto is now allowing you to dispute certain parking violations via e-mail. Meter violations that are given in error due to a broken meter or your permit not being visible, can be resolved online. You fill out on online form and the City conducts some kind of investigation. I do give credit to Toronto for this, since it's usually easier to just ...

Re: Parking Vehicle Facing Wrong Direction?

In short... is there a way I can dispute or much preferably settle this without having to waste gas to drive to Mississauga and settle this as a dispute in person? I would cost me about $8 in gasoline (assuming only one trip) just to save myself from a $20-25 ticket.

Unfortunately to dispute the charge you would have to attend Court at least ...

Agreed. That information doesnt prevent you from defending yourself, so it would not be considered a fatal error.

Failing to drive in a marked lane - Case law

Did a quick search and couldn't find this decision on the forums. The case is R. v. Capobianco, a somewhat recent Court of Appeal decision.

The Courts have ruled that for the offence of failing to drive in a marked lane, the Crown must show:
1) The accused failed to drive in the marked lane AND
2) The manoeuvre was not made in safety

It used to ...

Depends on your provider/policy and record. Many overlook your first minor conviction.

Re: Pay tickets or go to court?

Technically your husband did commit all three offences, even if the dealership mixed up the plates. I'd suggest seeking a first attendance meeting with the Crown and explain the situation. I would hope they'd be willing to at least drop one if not two charges in exchange for a guilty plea on the third. Just be sure to bring along a valid ownership ...

It won't. I personally think you're better off asking for information relevant to the offence since it makes you look more knowledgable.

Re: What happens if there is error on a Ticket?

I got a speeding ticket today. All the information on it is correct, but the charge is written:
Speeding km/hr in a km/hr zone.
No numbers. Would this constitute a fatal error?

See this thread: http://www.ontariohighwaytrafficact.com/topic2958.html

There is some case law that says if the fine is correct, the actual amount doesn't need to be on ...

Re: Are these "fatal errors"?

From the above would you see a continuity of evidence case?
Possibly. It would depend on the highway, level of traffic, time of day and how long sight was lost for. You would have to request disclosure and see what the evidence is. If the officer got a partial plate or reasonable descriptors, the fact you were in the same location with the same ...

Re: No Parking Signs Visibility

Are there rules and guidelines regarding no parking signs visibility, HTA act or extracts?

The majority of parking infractions are covered under local municipal bylaws.

I have no traffic minor or major infractions for 10 years

Just FYI if you're worried about a clean record, parking infractions do NOT show up on your driving history or ...

Re: Careless Driving Charge from statement from another driv

It would be a very good ticket to fight. The fact that you were following too close probably wouldn't be sufficient on its own for careless. If you were to fight the ticket the witness/complainant would need to be present at trial to give evidence unless the officer actually witnessed your driving as well.

Request disclosure, which would consist ...

You're 30 and worried about your parents finding out?

Life happens and we all make mistakes, yours is a pretty minor one. Be honest with your parents. If they go and renew their insurance saying you have no convictions, they could get in trouble if the insurance company finds out otherwise. All HTA convictions show up on your driving ...
