Re: Speeding ticket: 65 in a 50 zone (15over)
Without knowing all the particulars of your case and what evidence the Crown has, there is no specific advice that can be given. There are tons of posts and links on these forums that talk about general strategies for dealing with any kind of ticket. Read through them and it should give you a few ideas on how to handle your matter.

Re: what is the judge handing down ?
Something like that would be completedly dependent on your past convictions and circumstances of the offence. Also, while your offence is driving related, it falls under the Criminal Code and not the Highway Traffic Act, which is what this forum deals with.

Re: Incomplete/improper disclosure
RO is frequently short form for registered owner. Was the vehicle you were driving registered to someone else? It's not really relevant to the speeding charge, but many officers record if the driver is also the owner as a matter of habit.

Re: two issues in received disclosure
Questions are: should I send a second disclosure request asking for typed notes (I asked for this in my first request and it seems that it has been ignored)?
If you honestly can't read them, then you could request a typed copy. Typed versions aren't automatically provided with every request, you have to show they're required.

Re: Rear-ended someone and ticketed "Followed Too Close"
1. Since the other cars are reported as stopped, how can I be ticketed for following too close? How can you follow a stopped car? Because you didn't leave sufficient space to stop your vehicle safely. You were following from behind and the car in front of you does NOT need to be moving.

There are some differences in the testing of one lidar unit to the next, though it's not night and day. After an officer has been trained on one lidar unit, they're qualified to use all lidar units. The expectation is that they simply read the manual for a different model prior to use.

It can be somewhat dependent on your conviction history and fines owed, but jail is pretty much a given on a third conviction.
That being said, based on your original post, your first conviction should have been for driving with no licence, not driving while suspended. Will this actually be your third charge for driving suspended? Or are you ...

Re: How to fight a careless driving ticket in Toronto?
Thanks very much for your input. My trial is scheduled for the 31st of this month. Is it too late to request disclosure and do I need to go to the traffic office to do this? There is no option to have a meeting with the crown on the white notice that I received in the mail. Is this meeting held on the trial date itself? Thank you.

I'm thinking the OP might mean the vehicle that struck him was in the adjoining lane, not directly behind him. If the involved vehicle was directly behind him, I don't think the charge would go anywhere in Court.

On top of the fine and demerit points, careless driving also tends to have some very serious implications with your insurance. Most providers classify any conviction as minor, major or serious. Careless is typically considered a serious offence and rate hikes of up to 100% are possible.

From your description it does sound like you committed both offences. While a photocopy of your ownership is acceptable, it must be a "true" copy, meaning front and back. When you receive a new validation sticker for your plate, there is a smaller sticker to go on the back of your ownership. Your copy must show the most recent sticker.

The only thing in the officer notes that seemed weird was the fact that he guessed I was going between 80-85 before turning on his radar. How would he guess within a 5kph range?

Re: right turn - mistake in municipality - Proctor/Bayview
An incorrect offence location is not what's considered a "fatal" error, where the ticket is simply withdrawn. When the officer suggested you bring the ticket to Court, she probably meant that if you have a first attendance meeting with the Crown, they'll offer you a reduced fine and/or less serious charge in exchange for a guilty plea. Some ...

I didn't think the fine would be so high. I'm pretty sure the normal fine you'd get on a ticket for that offence is $85/$110. I guess the Crown asked for more since they dropped it from Careless.

Re: Missed court date by accident, please help
You'd need to file a request for the JP to strike your earlier conviction and reopen the matter. I believe you only have 15 days from the date of conviction to do so. And as Simon mentioned, you'll need to explain why you couldn't attend. Valid reasons are you were never served notice of circumstances beyond your control. The fact that you simply ...

Re: Shitty situation - Help plz
You can request disclosure, which would provide you a copy of the accident report and witness statements. That would give you a good idea of how they determined you were at fault and how strong the case against you is. If there is a credible independent witness, it will be somewhat harder to dispute the charge versus if it was just you and the ...

Re: Speeding charge by pacing
200 metres sounds like a reasonable distance, especially if the officer can testify that she was going a set speed and clearly observed you pass her and/or pull away. She may not know you're exact speed, but can at least testify to the fact you were at least going X over. The longer you pace a vehicle the better, but there's no set distance and it ...

From reading the forums I know that the officer must test the laser before and after using it. On the notes that were supplied to me in the disclosure package, all it says is "ATL ##### OK M+T" It does not specify the time it was done and if a retest was performed after I was pulled over.

Re: Fail to Stop on Red
Unless there is some type of fatal error I don't see why the ticket would be withdrawn. The officer believes you entered the intersection on a red light while you believe it was on an amber light. The Crown won't withdraw the charge just because you dispute the evidence, that's what the trial is for. If you did enter the intersection on a red, the ...

Re: Accident in a parking garage, no charges yet but need ad
The police have up to 6 months to charge you with an offence, though it's unlikely it will take that long. The collision itself sounds like a relatively minor accident that would normally be classified as non reportable (meaning the police don't have to be involved and you wouldn't be charged) but since you failed to remain that's no longer an ...

Re: reasonable suspicion vs reasonable grounds to beleive
The simplest explanation is reasonable suspicion is a lower standard then reasonable grounds. Suspicion is the threshold that can allow police to proceed with an investigation, and reasonable grounds is the threshold to proceed with a charge.
One example would be if you're a G2 driver stopped by police at a RIDE checkpoint. The officer asks you ...

I'm pretty sure you're in the clear with that charge. Prohibited turns are the only bylaw infractions that I'm aware of to carry demerit points. Without demerit points, the conviction (if paid) should not appear on your record. There are a few other posters who are more familiar with bylaw infractions that can hopefully confirm this.

Yes, insurance companies typically look at all convictions, regardless of demerit points. That being said, a speeding conviction of 22 over would likely be considered a minor conviction. Most providers overlook your first minor conviction. If you get two or three minor convictions, then you could be looking at a rate hike of 5-10%. Major ...

Based on what you've said the charge for driving with no insurance sounds incorrect. I can't see forgetting to plate the vehicle rendering all insurance invalid. What if you're driving along and the dealer plate suddenly fell off? Are you suddenly uninsured? I'm also curious as to why you were charged. It's the owner/lessee who's responsible for ...

t's a fairly serious charge, so legal representation may be recommended. That being said, based on your version of events, I think it's quite likely the Crown would offer you a plea deal to some lesser charge such as fail to pull over. A legal representative could give you the best idea of how strong a case the Crown has with careless and whether ...

I'm not aware of any online PDF version of the manual. That being said, if you can show that the manual is relevant to your defence, the Crown has an obligation to provide a copy. If you haven't received the manual prior to trial, I'd notify the JP and ask for an adjournement until you obtain it. FYI they don't usually provide you with the whole ...

It entirely depends why you were suspended. When I look at the length of your suspension, I'm guessing it's for something criminal, in which case it's no longer a Highway Traffic Act related matter. If I'm wrong and it is HTA related, you'll have to advise what the suspension is for. Medical suspensions can be appealed, and there are usually ...

So to clarify, is it up to the police to decide to charge me? Or is it dependant on the owner of the other car?
They may seek input from the other driver, but ultimately the police decide whether to lay a charge or not.
Is it possible to settle this with only the owner of the other car (without police)?
