It means that he can be charged criminally and suffer those consequences (fine, imprisonment, driving prohibition), but they can't administer the roadside licence suspension which is under the Highway Traffic Act. That includes the new 50 milligram roadside suspension, but if he is impaired at that level then it once again falls under the Criminal ...

Re: Electric Bike DUI Impoundment?
An electric motor qualifies as "other than muscular power" so it is a motor vehicle under the Criminal Code.
O.Reg 473 allows a power-assisted bicycle to be treated as simply a bicycle under the HTA as long as it meets the standards of the CMVSA. However, that is provincial legislation and cannot modify the Criminal Code.

Oops, was just thinking "impaired" and "bicycle." Had a bit of impairment myself with my pizza.
So while the licence suspension can't be applied, he would not have been allowed to continue driving while impaired, thus the vehicle was towed.

That's what I was thinking as well, kind of like the "Printed in Canada" labels on things that aren't even printed (just the package).

Re: Electric Bike DUI Impoundment?
An electric bicycle (power-assisted bicycle) is a bicycle as far as the HTA is concerned, aside from the fact that you must be over 16 to ride one and you must wear a helmet.

Re: TPS bicycle registry
Oh, I read something a while ago that gave me the impression that CPIC didn't track bicycles (it was an article on one of those Canada-wide paid bike registries). Good to know, and I do have the serial number written down.
If you guys ever see the only bike in Ontario properly taped up according to HTA, let me know my bike has been stolen.

Would this only work for bicycles recovered by the TPS? That is, would OPP, York Regional, etc., ever reference or even have access to the registry?

I wouldn't mind them making money from driver testing and licensing, but that money should be going to the Government of Ontario, to put towards general road maintenance and - God forbid - studying ways to improve traffic flow/safety and improving the efficacy of the testing procedures.

Parker used to make several pen models in Canada, but they've stopped. The ones I saw were Made in UK or Taiwan, I think.
I'll need a new bicycle chain by the end of the year...know any Canadian manufacturers? So far it seems like I've found Canadian manufacturers of everything but chains. Lots of frames made here.

Could it read 7 (5) (a)? That's for failure to surrender permit. 7 (5) (b) would look more like (5) (5), but that is for a trailer permit.

Bring back the two-dollar bill, and have the only coin be the quarter (and perhaps the loonie, being the symbol of our existence and such).
I've converted a lot of coins over to Canadian Tire money.

I don't remember there being anything saying that two vehicles cannot occupy the same marked lane (although it seems like it should be a law!). Section 154 just requires the vehicle to be driven entirely within a marked lane. Anyone know differently?

Does it just happen on 64-bit systems? I'm using Firefox 3.0.1 on OpenBSD 4.4, with an ancient Pentium III processor (32-bit). Loads just fine for me after blocking formassembly.com. That script used to hang the site loading for about five seconds per page.

Re: Failure to furnish required information Sec 199 (1) accident
You should call your insurance company. When I had my hit-and-run, reporting to the collision centre should have automatically notified the insurance company - however, the agent I spoke to two days later had no record of it. Reporting an accident is separate from making a claim on the accident - if at fault, your rates will be affected less with ...

You should read the applicants/recruits threads on the Blueline forums. Over here, only about 5% of the Police Foundations graduates get onto any service right away, so have a backup job or even a career prepared to support yourself while you apply.

What if Ms. Raham here pulls a Myers, gets tired of all the brouhaha, and quietly takes a deal? Is the previous court ruling still binding on lower courts (JPs), or is it treated as if the previous ruling(s) never happened?

May have to go to case law on this. All that's mentioned in the HTA is
No person shall park or stand a vehicle on a highway unless he or she has taken the action that may be reasonably necessary in the circumstances to prevent the vehicle from moving or being set in motion. R.S.O. 1990, c. H.8, s. 170 (9).
