this was brought in to the UK (when I was there) about 5-6 years ago and is a pile of junk.
on the M25, on certain stretches, they have a variable speed limit. usually on the motorway it's 70mph, (though most people conservatively do up to about 80) on busy days, they change it to say 50

That may have been the case in the UK however in Germany ...

In 2005, the government passed legislation that enabled the introduction of variable speed limits at some point in the future. It didn't take effect right away, so it sat waiting for "proclamation by the Lieutenant Governor." Just by chance... I was reading the HTA earlier while browsing this forum, and this section has now been added:

Some places use a sort of administrative system like this one (e.g. New York City). On the face of it, I'm not sure what to think of it, although in all likelihood they'll just turn it into a system for rubber ...

The correct thing to do is, if you are the first car in line, enter the intersection on the green and wait in a safe place. Theoretically only one vehicle should enter at at time... this isn't practical in real life in a place like Toronto (at least two are in the intersection) but we're talking a driving test here. I realize this is a very late reply but the HTA does not set out a qualification on exactly what the medical standards are, except that if your attending physician feels that it is unsafe for you to drive, he/she is to notify MTO.

I get the impression that he didn't think it was entirely unsafe, but definitely thought it was less than ideal. Just ...

Agreed. Unless you can find a way to prove the camera was likely malfunctioning (good luck with that), the best thing to do for red light camera tickets is simply to get a reduced fine. Your insurance is not affected, your driver record is not affected, you just pay some $$$. That's it.

There are some statistics that show an increase in collisions ...

And also the Prosecutor should be recognized for dropping the charge based on the fact that you made a reasonable effort to obtain disclosure, and then did the time calculation and decided not to pursue it further. It was the right thing to do.

If the other driver doesn't come, will it get thrown out as well. I'm 95% sure that he won't. He's a busy guy who travels a lot and didn't think I deserved the ticket.

I wouldn't gamble on that one, but if he doesn't show up there's about a reasonable (but not certain) chance it will be dropped. I witnessed a collision about two years ago ...

Not really sure that will work, the officers will likely say that they radioed each other and that's it (which, they almost surely did).

Have you looked for any other issues, such as no indications of testing the speed measuring device, no tracking history (i.e. visual observation of the vehicle), etc?

Well it sounds like the Prosecutor's office did a good job with the disclosure - you got everything you'll need. If you can't read the notes, you can ask the officer to read them to you prior to trial. However, if you then request an adjournment to prepare, the delay will probably be charged to you.

Your insurance is not affected until you are convicted/plead guilty. So don't worry about that for now.

94 km/h over if convicted... I'm guessing:

- $4000 fine
- 2 year licence suspension
- 3-7 days jail

So yes worse than for a drunk driver who would get a 1 year suspension, some probation and no jail.

Agree with highwaystar.

Just produce proof that you were insured at the time you were pulled over and the main charge is gone.

I don't know of any companies that count "failure to provide proof of insurance" as a minor conviction, but I could be wrong. In any case IIRC it is $65 for that one...

You might get a licence suspension and a large fine, not sure the length of the suspension. Anyway, I would recommend hiring a paralegal who has experience dealing with this sort of thing. That's your best option at this point. They might find something that can get it reduced to 49 over instead of 60 over, but I can't promise anything. Call around ...

I would probably pay the ticket if I were you.

Insurance has to cover your costs in cases like this, unless you did something that would void the insurance (e.g. drove suspended, or something to that effect). So although the judgement is against you, the insurance company will pay it out. However, they will, of course, raise your rates ...

Bilingual defence was (more or less) quashed on appeal.

IIRC, the argument the city made is that while Toronto is a designated area, that applied only to provincial government services and the city never committed to providing fully bilingual service. Therefore, all MTO signs had to be bilingual (which they are) but city signs did not...

The courts have no control over demerit points. If you plead guilty or are convicted, demerit points are automatically assigned by MTO.

If you want to plea-bargain to a lesser charge with fewer or no demerit points, that might help you, but pleading guilty only helps with possibly getting a lesser fine.

If you have an early resolution meeting scheduled with the Prosecutor, you can always say you are interested in pleading guilty but looking for a lower fine. Unfortunately at this stage, you're pretty well committed to going to court, but you can make it quick and painless.
