The OP obviously had NO IDEA you're supposed to call the police when you get into a car crash... because, you know, he only called the police immediately.

Re: Turn Not In Safety

I had hoped to subpoena the traffic cameras footage of that day. I even contacted the city offices but told me that they do not record anything on traffic intersections. Cameras are there for monitor purposes. I dont know how truthful that statement would be.

They are also used to monitor traffic volumes, or particularly with a college ...

Re: Turn not in safety- collision

Technically... the officer did follow the exact letter of the law by charging both of you. It sucks, given that the other driver should've stopped, but the Highway Traffic Act does say that you need to ensure that it is safe to turn before you do so... and unfortunately that also includes watching out for red light runners. Anyway... I would still ...

Re: Turn Not In Safety

I'm not really clear about what happened.

Did you turn across the path of an approaching vehicle, merge into the side of the vehicle or turn into another vehicle's lane?

The insurance company is concerned with two things:
1. Who is at fault for the collision, and how much
2. HTA convictions

You won't be able to change #1. They use Fault ...

I'd check your insurance contract to see what your obligations are. Generally, they will ask you if you renew your insurance "have you had an accident," but some of them require ALL accidents to be reported even if you don't make a claim; others only care if you make claims.

I'd agree with Stanton. Now before we get too carried away here:

Driving while suspended = Minimum $1000-$5000 fine. 6 month suspension.

Try to plea-bargain this one down to Drive with No Licence. That's much less serious, and, given the circumstances, they may agree to it if you plead guilty to these other offences:

1) Can I request a disclosure before submitting my response to the charge? Mainly, do I have to pick option 2 or 3 first?

No - you have to pick 2 or 3 first.

2) If I request a first attendance meeting (option 2) does that mean I am pleading guilt of some sort? If I do not like the outcome of the meeting with the prosecutor, can I then request ...

Re: DUI charge on Private Property but NOT caught in the car

My question is how can they charge her a DUI, they have no proof that she was in the car and she didnt admit to it as she's already inside the house when the cops came. Although her bf's story seems to be more in favor as they can see the damages on both cars but that could have happened before or some time ago.

The damage is consistent with ...

Arguably that monkey might be a better driver then some of the more stellar Torontonian motorists I've seen.

MIGHT be? I think you're not giving the monkey enough credit.

Speaking of which, in New Zealand, they actually taught dogs to drive for a short distance (about 100 metres). They went in a straight line. This also demonstrates higher ...

I've had the opportunity to use LIDAR and radar. I was able to take 2 readings less than second apart. My suggestion would be to avoid trying to go the route of "he couldn't have done it in 'x' seconds" if you want to fight this charge.

Re: Middle car in sandwich rear-end. Careless??

I'd get a paralegal involved as well. Certainly from your description, I don't believe that you should have been charged with Careless Driving. However, as Careless Driving is a very serious charge with some pretty heavy implications for insurance etc., I'd get some sort of professional representation. Unless the officer was a collision ...

Another thing to watch for in Toronto parking lots

Apparently, "normal" stuff like cars, pedestrians, etc., aren't the only things you have to watch for now in parking lots.

You might also have to look out for:

Rhesus Monkeys!

HUH?! What kind of guy would get a monkey for a pet, and not only that, but get it a jacket and then leave it in the car while shopping at Ikea?

Chalk it up to the other drivers being neurotic, or just not understanding how to work their vehicles.

Well unless the road you turned on to also had a No U-turn sign that I couldn't see... you didn't disobey the U-turn sign. The "NO U-TURN" only applies on the highway it's posted on, not to other roads in the vicinity.

Re: Rear Ended Someone Months Ago (did not report to Insuran

Tell your insurance company the truth as best you can recall. Just answer their questions, and tell them that you didn't file a claim because you didn't have much damage to your vehicle so didn't want it repaired.

They won't make you pay for the other car's repairs yourself. However, they could raise your rates.

Re: Force Fatal Error?

I agree with Daggx and tdottopcop. The wrong vehicle type is likely not going to result in the ticket being quashed. Actually, it won't, because the JP only examines the ticket for known fatal errors (missing date, missing defendant name, offence not known to law, missing/incorrect set fine etc). They only need enough to convict. If they've got a ...

1. Does a violation that is eventually withdrawn by the prosecution (i.e. issuing officer doesn't show etc) stay on the offender's driving record, for any definite period of time (that-is-to-say, the record which a then-prosecutor would see if such offender were to end up back in traffic court weeks/months/years later)?

No. An offence that you ...

Given that the speed you'd be convicted of (8 km/h over) is such a meagre offence (really? 8 km/h?! Who tickets for 8 over?!) I'd go to court and see what is in a plea bargain, if nothing else.

Fight the ticket, and put in a disclosure request. The disclosure request will help you get the evidence the Prosecutor intends to use against you. For ...

Yeah I'd get a paralegal or a traffic lawyer involved. This has some pretty significant implications for not only your driving record, but also your insurance. There is a possibility that you could get the charge plea-bargained down to "leave roadway - not in safety," but I still would get professional help on this one.
