HI Gents, A question of malpractice I want to say, hope you can offer some guidance, as this is the internet the crux is this 2015 I had a ECG, report and trace showed I had a heart issue. 2021 The report was correct as 6 years later I had a heart attack, near fatal In 2015, doc did not disclose results said all was good, so I did not have a warning should have also been referred to a cardiologist, for monitoring and heart drugs SO... I only found this report last week, when I was clearing out some files of my computer. I transferred from that doctor to a new-doctor approx 2 years ago, my old doctor gave me the files on PDF to give to the new doctor as he didnt want to fax them (about 60 pages) I did that, BUT I decided to have a look through my copy to see if I needed to keep anything or trash, thats when I found the original ECG and the labs doctors report SO question, can I sue ? I believe ont has a statute of limitations of 2 years ? As this is information I would NEVER EVER have seen and came about it by accident. please thoughts

Did some more digging, 2 years SoL (no not the other SOL LOL) but yes that also does makes me SOL, so both. I can only lodge a complaint with ONt Board, more than likly all docs will stick togther and as no one was killed, maimed or sexually assulated I'll get a dear John letter. You're right that you're SOL on a lawsuit. The Limitations Act, 2002, is crystal clear on a two-year limitation period for almost any cause of action in Ontario. With regard to a complaint, you would have to check the policies and procedures of the College of Physicians and Surgeons of Ontario. There may be a time limit there as well.
