The police officer ripped my ticket (79 in a 50) through his name when writing it. Does that qualify for a fatal error? Both copies would reflect this damage as it is a puncture with a pen.
Thanks

Re: Ripped Ticket
In my experience, the question the courts usually ask is, "Does the error negatively affect your ability to make a full defence to the charge?" If the answer is yes, the errors are usually considered fatal.
Re: Ripped Ticket
Ripped ticket is probably not a fatal error.
One more thing...
Thanks.
One more question.
I was rounding a corner and there were two large signs, and a cluster of about 4 trees blocking the officer's line of sight to the roadway, yet he used his speed measuring device through them anyways. The officer was already walking out on the roadway when I rounded the sign. I am just trying to round up some case law where the defence was won based on an obstruction to the device created reasonable doubt.
82 in a 50 zone, will lose my licence for 30 days due to the four points as I am a hybrid driver (GM2).
Thanks again,

Re: Ripped Ticket
You are classed as a full G licence, with addition of the M2
HTA OREG 340/94
9. (1) The Registrar shall, after giving notice, suspend or cancel the drivers licence of a novice driver as provided in subsection (2) in the following circumstance:
(3) An offence under the Act set out in Column 1 of the Table to the Demerit Point Regulation for which the number of demerit points set out opposite thereto in Column 2 is four or more, regardless of whether or not demerit points have been recorded
10 (3) Subsection 9 (1) does not apply with respect to a conviction for an offence described in paragraph 3 or 4 of subsection 9 (3), if at the time of the offence,
(b) the holder of a Class M1 or M2 drivers licence also holds a Class A, B, C, D, E, F or G drivers licence
Re: Ripped Ticket
Thanks for the reply Hwybear.
So basically... that means I won't lose my license? The MTO website implied otherwise.

Not too sure of case law. Have you filed for disclosure yet? If so, one of the key components that they need to give you is access to the radar/lidar manual. If it says an absolutely clear line of sight is required, you may be in luck.
Re: Ripped Ticket
Thanks Radar,
Can I file for and receive disclosure before my first summons? Or do I have to wait until after that?
Re: Ripped Ticket
Request it now.............
Re: Ripped Ticket
Agree with Reflections. If you have a court date and/or First Attendance date, go ahead and request it now.
I got a speeding ticket on the 401 by Cornwall. The officer said I was going 140 initially then dropped it to 130 (for the record I don't believe for a second I was going 140, that's way faster than I would ever intentionally drive). I filled out the info on the back of the notice to request a…
I was recently charged with stunt driving on a 60kmh road. When I was pulled over, the officer told me I was going almost 100kmh (still 40kmh above the limit) but was charging me for stunt driving because I accelerated quickly from an intersection on an empty road (in a straight line). I know…
Hi everyone,

Are any non-domestic vehicles "pursuit-rated" in North America? Also have the Michigan State Police (this is relevant because apparently they have the most accepted selection/testing process) tested any of them to see if they meet their criteria? Just curious...
Ottawa, Canada (AHN) - Beginning Tuesday, or April Fool's Day 2008, fines on Quebec drivers caught overspeeding will be doubled. It is not only the money penalty that will go up, but also demerit points.
The new law, Bill 42, is similar to Ontario's street racing rule. It stipulates fines for…
Hi,
A friend got a ticket Jan. 9th of this year for doing 110 kph in a 90 kph zone, so 20 over.
What should the set fine and total payable read?
It's confusing to me, as the prescribed fine under HTA s.128 is different than the set fine enumerated by the Chief Justice of the Ontario Court of Justice.
Wh…
An OPP officer ticketed me claiming I was going 40km/h over the limit (140km/km) on my way home with a few friends on the 401. This is my first ever speeding offense. Although I am sure I was over the limit, I am almost certain that I was not going 40 over, more realistically closer to 30 over. The…
Hi Guys,
Yesterday night I was charged for stunt driving (excess over 50km/h) and I have a few inquiries. I'm sure you've all heard the same story, but the unmarked cop in an SUV was tailing me for a good 2-3 minutes as I was travelling 120~135 km/h. Then as he came close I decided to boot it up…
I've been reading this site while waiting for my court date. My court date came in 2 weeks ago, and it is for August 22, 2011.
Brief first, than charge.
The Brief

I had a speeding ticket in May 2013 which brought me to 9 demerit points out of 15. I received a letter and had to attend an interview. Due to a history of speeding tickets and a previous interview a few years prior, the interviewer decided to put me on zero tolerance for a year. Meaning if I…
