If the website accepted your payment then you should be fine. While they can technically get a default judgment against you after 15 days, it usually takes them more like 30-90 days to actually get around to it.

The Brampton bylaw regarding heavy trucks also has an exemption for trucks that are dropping off or picking up on a street that has a no truck sign. There is no harm in booking a court date and requesting disclosure and there is no risk of the fine going up unless you actually go through with your trial. It never hurts to review the disclosure for mistakes and to talk to the prosecution about a possible break on your fine. If nothing else booking a court date will push you having to pay your ...

If this happened in a major urban area I think you will most likely never hear about it again. Most police forces in large cities have a backlog of major crimes to deal with and don't have the time to chase down a minor traffic violation, which at the end of the day is all this is. They have 6 months from the date of the infraction to serve you with a summons to court, so they are still within the legal time limit.

I would contact the Ontario Motor Vehicle Industry Council. They regulate car sales in Ontario and enforce consumer protection legislation when it involves the sale of cars.

I agree with the others. For a careless driving charge they would have to prove you were driving. Assuming you didn't give this guy your name, they will have no way to do that. Yes, all tickets issued under the Highway Traffic Act appear on your driving record. This ticket is considered minor so you may see a small insurance increase or none at all depending on your insurance company.

I would file for a court date with the officer present and when you get your court date in the mail request disclosure of the officer's notes so you can see what evidence the prosecution has against you. Go with option 3 it gives you the most flexibility and keeps all your options open. That way you can negotiate with the prosecutor, or go to trial and try to beat the ticket, or if you change your mind and just want to pay you can do that too right up until your trial actually starts.

If all you're looking to do is get the ticket reduced then I wouldn't bother hiring anyone as you can plea bargain with the prosecutor yourself. If I were in your position I would plead not guilty and request a trial with the officer present. Then when your notice of trial arrives in the mail I would request disclosure to see what evidence they ...

I think challenging the legality of the fire route is probably the best way to go as well. I agree with argyll, there is no point in booking an early resolution meeting at this point. Just show up a few minutes early on your court date and meet with the prosecutor before court starts. As he said, you won't be the only one, lots of people will be there looking to cut last minute deals.

The only thing you can do for now is file for a court date and request disclosure. Once we see what is in the officer's notes we may be able to mount some sort of defence.

The maximum punishment for driving while disqualified is 5 years in prison. The first line of section 168 tends to suggest that it only applies when head lights are required. Since head lights were not required at the time the time of the incident I think your friend can reasonably argue that he is not guilty of the offence.

Yep this looks like a classic fatal error scenario. The best thing to do in this situation is ignore the ticket and wait to see if it gets quashed. If it doesn't then you can appeal citing the London v Young case.
