Unfortunately, like the others have said, once you pay a ticket the courts consider the case closed and it is next to impossible to get them to reconsider the matter. At this point the only thing you can do is ask the insurance company to reconsider your rate, like curiousottman suggested, or shop around for a better rate from a different company.

I think if you explain at early resolution that you live at the address on your licence and were just borrowing the car then that ticket should get dropped, if you have some additional proof that you live there like a utility bill or a rental agreement, that wouldn't hurt. I went through this with a red light ticket I got back in 2011 that had an incorrect set fine. I got the ticket on May 18th but they didn't send me a letter saying I had been convicted until July 29th, so it can take some time. Why does the prosecutor not have the right to quash the ticket if I were to choose option 2 and meet with him?

Technically no trial has started but I'm trying to avoid wasting anyone's time taking a case with a fatal error to trial. If i meet with the prosecutor prior to trial to let him know that I will not be ...

Does the Ontario highway traffic act state anywhere online that a missing fine on a ticket is indeed a fatal error and would be a successful reason to appeal a conviction?

As OTD said, they can serve you with a summons up to 6 months after the offence. Although that would be served on you personally by a police or court officer, it would not come by mail. Usually the only tickets that come by mail are red light camera tickets. That having been said most police forces won't issue a summons based solely off another ...

Unfortunately my reading of the Provincial Offences Act suggests that they can ticket you into the court of an adjoining jurisdiction so I don't think it will matter which side of the Brampton/Newmarket boarder your were on. I don't have a problem with them in school zones. Especially if there are signs in place that say photo radar ahead, much like there are with red light cameras now.

Unfortunately some JPs aren't as well versed in the law as one would hope. If you are satisfied with pleading to the Bylaw infraction then I wouldn't do anything, but for anyone else in this situation you could almost certainly appeal and at least win a new trial.

Alberta is one of the provinces that has made a deal with the Canada Revenue Agency to divert income tax refunds and GST rebates to pay outstanding fines. If you ignore the fine at some point in the future you may see your tax refund clawed back to pay off the amount owing plus any accumulated late penalties.

Given your situation it would probably be best to file for a court date. This will at least give you several months of breathing room while you figure out what you are going to do next. There is also a chance that some way can be found to beat the ticket.

There are two provincial offences offices in York Region. I'm not sure which one applies in your case so I posted the numbers for both. I would double check the fine print on the ticket though, usually they have their contact info on there somewhere. If there is nothing on the ticket, try calling both offices and see which one is the right one ...
