Re: Compulsory Automobile Insurance Act 3 (1)

Having a slip for a different car even with your name on it does not mean you may be insured in the vehicle you are currently driving and should not be accepted as proof of insurance. Some policies cover you for a period when you buy a vehicle. You should have that policy with you to show the officer.
If the slip says the driver (operator) is ...

If you can afford insurance in Ontario you can afford pretty much any paralegal. The chain services like xcopper, points and ott legal are comparable and professional. It will be a drop in the bucket compared to what you are facing in increased insurance premiums. Pay the money and put it in their hands learn your lesson and go back to studying.

Was the letter mailed to an Ontario address? They may think you still have an on license.
You can't take back a guilty plea.
Ontario has no jurisdiction over your pei license.

I um under the understanding that true copies are acceptable. I would say that a photocopy that has been signed is not a true copy because it has been altered. Even so what constituents a true copy is a matter of some debate.

Anyone want to weight in on if a uncertified copy can be considered a true copy?

Re: No charges but insurance says I am at fault for accident

In any situation relying on another driver's turn signal to make a decision as to when you feel it is safe to turn is problematic because you have no way of knowing if they have a malfunctioning signal light, forgot their signal on etc. I don't mean to sound condescending but your experience illustrates to everyone that you are always better off to ...

Re: Would this be enough for an appeal?

If the officer mentioned the sign and you didn't object to it or address it under cross examination then it becomes part of the testimony that can be considered. You should only consider an appeal if you can cite case law that supports that the JP erred in their application of the law. Mistake of fact is a grounds of appeal but you would have to ...

Re: 2 Tickets, 140 in 100 and failure to surrender liscence

You should always review disclosure to see if the evidence against you will support a conviction. You do not have to testify during your trial, all you have to do is poke holes in the case against you.

If you are not going to dispute your guilt you can ask to meet with a prosecutor and ask for lower charges in exchange for pleading guilty to one ...

Personally I don't think this one will float. It looks like an incomplete 8. You will have to argue it is an E in your (likely unsuccessful) appeal. You could get lucky some JPs are former teachers who are just itching to punish former students for poor penmanship. Before you put your hopes on this Hail Mary review disclosure. Other thoughts?

Re: I feel like I am getting screwed here.. advice appreciat

In short the answer is: Yes you are being screwed? By whom? The answer is by you. Your unwillingness/inability spend on an experienced professional to defend you against what is a very serious charge. It doesn't matter if the charge is trumped up having inept representation against a seasoned prosecutor is a serious mistake. If you plan to fight ...

Re: Just came back from court by myself....did I dodge a bul

If you are going to court to agree with the officers version of events then it is best that you plead guilty. Disclosure means you are entitled to study the officers notes about the events that transpired in relation to the charges against you before the trial takes place. The officer reads them before the trial and then paraphrases their contents ...

Daddy will not be too happy. I'm sure like most parents today he will find a way to blame the officer for doing his job; same like when they blamed the teacher for giving you a D in English so don't sweat it. It's too late now since you cannot take back a guilty plea. You might have been able to get the charge withdrawn if you had investigated all ...

Fight it like any other speeding ticket. If the evidence against you is strong enough to support a conviction, there are no loopholes you can use to your benefit then you make a deal at that point. Search the thread and see if what others in your situation have done. Keep in mind that you could be convicted of speeding if you admit to going 1kph ...

It was an at fault accident, I'm guessing you made a claim for damages so they know what happened.

Careless is tricky, if you plan to go all the way you really need to do your homework and cite the applicable case law. Your biggest obstacle will be that when an accident involves poor weather it can always be argued that you were going too fast.

Re: 145kmph in 100kmph zone, is this consider a "fatal" erro

If you don't have disclosure and receive it at trial the delay will be counted against you eliminating the possibility an 11b charter challenge. Without disclosure any defense is like playing cards without asking to see the other players hand. The rules say that upon reasonable request you are entitled to see the evidence against you before you go ...

At this point until you receive a trial date and request disclosure you will not have a great idea of what the officer will say when they testify. Testing is important or they wouldn't do it.....I would ask if he tested the unit at the end of his shift and if he says yes ask why it was not in the notes you received. Re: Summons to appear in court for Careless Driving

Go ahead and file the 11b. If you asked for more time and another meeting it could be seen as a neutral delay. (it is really up to the JP to decide) 12 months should be sufficient but it's not a slam dunk. Given how serious a careless charge is I would hire someone reputable to file the 11b whom can make the proper arguments on your behalf. It ...
