Re: Ticket for holding handheld device while driving

You are going to have to ask for disclosure at trial (you should have asked for it when you got your notice of trial), that will indicate what evidence there is against you. If you need more time to prepare your defense ask for an adjournment. There are no points either way but they will likely offer you a reduced fine for pleading guilty. If you ...

Re: Turn not in Safety - no evidence

Go to court the prosecutor might try to offer you a reduced charge in exchange for pleading guilty politely decline and ask to proceed to trial. Make sure they know you requested disclosure and received back that there is no evidence. At that point any ethical prosecutor would tell you to sit tight and that they would withdraw the charge. Whatever ...

Snow tires not giving you as much stopping distance you are used to is not going to help. Careless is a serious charge and you should request a trial, ask for disclosure and see what the evidence against you is. Never plead guilty before you have examined the case against you. If you speak to a prosecutor you will very likely to be offered a ...

Unlikely but it is possible (they like to save jail time for people who intentionally crash their cars in fits of rage). There a lot of women in in shelters seeking protection from abuse (either actual of the threat of) suffered at the hands of jealous partners. Your criminal record as related to this charge will be sealed if you keep your nose clean. Your driver record will not be sealed because that is not part of your criminal record it is simple a drivers abstract showing you license history over the last 5 years. It will show suspensions, HTA convictions, the type of license you have and when you ...

Re: Approached by officer, threatened with summons

If you get a ticket for blowing by a school bus with signals at least one the witnesses is going to have to testify against you. Unlike police officers civilians are not paid to be witnesses so someone would have to be pretty motivated to show up to testify against you. More witnesses may actually be better because it is more likely that they will ...

I'm not an expert but even if the officer might have been following protocol not to exercise discretion but that is not a defense. Only way to beat the charge during trial is to argue successfully that would were not being careless. Re: Minor rear-ender at stop sign; exaggerated injury claim

If she was injured or not is not relevant to your defense. The other driver not showing is likely going to hurt the case against you but remember you made statements to the police officer likely admitting that you rear ended another car. Even if you proved there was no damage and no injury I would not expect that you will get off. You may be ...

The only thing you have proof of is there was an ambulance in front of you with flashing lights. As long as the bus is substantially unmodified it should be able to qualify for historic plates. I wouldn't consider setting up some bunks on the inside a substantial change. Plenty of old commercial vehicles qualify: old fire trucks etc. If the bus were taken on the road and was unsafe a police or MTO officer could seize the plates. Either way it ...

There is still a chance that the officer is a no show and there is a good chance that you can plead guilty to a reduced charge. You could also to for more time to review the evidence because you just received disclosure yesterday and haven't had a chance to review it. Good luck.

I am not understanding what you did or where you turned from to where. Bottom line is that if the sign was obstructed or was not on a white background then you might just win. For the record I don't see a left turn sign with a yellow background are these street view captures or did you take these photos?

In my opinion all tickets are worth fighting if you have the time. Note this is a minor conviction so it may be overlooked by your insurer, BUT if she gets into an accident or has another ticket all bets are off. You would have to call and see what your insurers specific policy would be.

For your purposes the sign said do not turn at this time. You did. This sign is visible for 60 meters before the intersection so it is a legal sign. Arguing that the sign is rare or unnecessary is going to result in a conviction. Time for a new strategy.
