Blowing a warn is not an offence for a fully licensed driver in Ontario. Each time you are caught in the warn range you will receive an extrajudicial series of escalating sanctions (suspensions and eventually mandatory treatment programs) that if you comply with them, they cannot be used against you from an insurance standpoint as bend said.

Back in the day you used to be able to remedy non-moving violations at the police station. This still might be the case in small town Ontario. If this is what the officer said I would take him at his word. The delay would be attributed to you so it will count against you as far as an 11b will go. I wouldn't volunteer the fact that you were aware that you could request disclosure before the trial.

You have nothing to lose other than time by going to trial. The odds of the driver not showing are much greater than the officer not showing. Even if they are both present, you might not have received disclosure yet and can easily ask for an adjournment to review the disclosure, giving you another shot at the witness being a no-show. If you were not given a ticket at the scene they have 6 months from the offence date to issue a summons for any potential charges.

It will just show up as an administrative suspension. Unless something changed it does not say why but there are a number of reasons like medical, stunt driving, and not paying a fine or child support. It cannot be used by an insurance company to raise your rates unless it is over 1 year.

Your best defense would be if you could honestly testify with absolute certainty that you stopped completely for a split second and proceeded. It is all about credibility. You'll have to suggest the officer made an honest mistake. If your testimony is as credible as the officer's, then the Justice aught to give you benefit of the doubt.

This is one of those situations where you don't bring it up until the appropriate time during the trial. You are not required to wear a seatbelt on private property that is not designated a highway (some parts of shopping mall lots are).

In Ontario disclosure a disclosure request is made once you have a trial date. When you get the Notice of Trial you can fax a request to the court house. Most cities have disclosure request forms on their website ...

This is a dime a dozen ticket. There are a lot of strategies but if the case is solid and there are no technicalities you may not be any better off. It never hurts to try if you have time so requesting a trial and reviewing disclosure is a good first step. If you want to see outcomes try searching the forum.

1. You can sell the car.
2. You will not be able to renew your plates on any vehicle that has the same registered owner, and I believe this applies to drivers licence renewal as well.
3. If you don't pay the ticket you will have big problems. They never go away....EVER.

If you cant afford the fine and have not been convicted yet, request a trial ...

Typically you plead not guilty and ask for a court date, when you get one, you request disclosure to see if the evidence against you can support a conviction. From there you can decide if you want to seek out a plea deal or fight it. Possibly, you could potentially beat the charges in other ways such as it taking too long to come to trial, officer ...
