Blowing a warn is not an offence for a fully licensed driver in Ontario. Each time you are caught in the warn range you will receive an extrajudicial series of escalating sanctions (suspensions and eventually mandatory treatment programs) that if you comply with them, they cannot be used against you from an insurance standpoint as bend said.

The delay would be attributed to you so it will count against you as far as an 11b will go. I wouldn't volunteer the fact that you were aware that you could request disclosure before the trial.

You have nothing to lose other than time by going to trial. The odds of the driver not showing are much greater than the officer not showing. Even if they are both present, you might not have received disclosure yet and can easily ask for an adjournment to review the disclosure, giving you another shot at the witness being a no-show. If you were not given a ticket at the scene they have 6 months from the offence date to issue a summons for any potential charges.

It will just show up as an administrative suspension. Unless something changed it does not say why but there are a number of reasons like medical, stunt driving, and not paying a fine or child support. It cannot be used by an insurance company to raise your rates unless it is over 1 year.

Your best defense would be if you could honestly testify with absolute certainty that you stopped completely for a split second and proceeded. It is all about credibility. You'll have to suggest the officer made an honest mistake. If your testimony is as credible as the officer's, then the Justice aught to give you benefit of the doubt.

You are not required to wear a seatbelt on private property that is not designated a highway (some parts of shopping mall lots are).

This is a dime a dozen ticket. There are a lot of strategies but if the case is solid and there are no technicalities you may not be any better off. It never hurts to try if you have time so requesting a trial and reviewing disclosure is a good first step. If you want to see outcomes try searching the forum.

1. You can sell the car.
2. You will not be able to renew your plates on any vehicle that has the same registered owner, and I believe this applies to drivers licence renewal as well.
3. If you don't pay the ticket you will have big problems. They never go away....EVER.

Getting hit by a truck will show quite a bit more damage than a car even at low speeds. If you were t-boned by a truck going 70 chances are you would not be here to tell the tale.

So the question, to which I do not know the answer, is this ... If he was speeding, does part of the fault fall on him and his insurance, versus 100% fault for you ...

So it sounds like the charge was withdrawn and then a summons was issued. They are allowed to do this if they submit the paperwork to the court within 6 months of the incident. Has it been 6 months? If not you're going to have to be prepared to defend the case in the same way you had originally planned. If yes, you're in luck....again.

The officer can testify that you were speeding and that he knows you were speeding because he paced you, visually estimated your speed, or used radar/laser. As you know this is a very serious charge as far as the HTA goes.

You can either:

Attend the court date collect disclosure and see if the evidence against you will support a conviction then decide if you want to seek out a plea bargain or fight the charge.

I believe the standard clause is that "the owner shall not drive or allow the vehicle to be driven unless that person is authorized by law to drive it." If they pull a drivers abstract there will not be a conviction but they should see an administrative suspension but not the reason. Other reasons for an administrative suspension could be for a number of reasons including, unpaid fines, a medical suspension or not paying child support.

If you have a full G licence blowing a warn cannot be used against you for insurance purposes because the 3 day licence suspension is administrative and not as a result of a conviction. Repeatedly blowing warns in a certain time frame will lead to escalating administrative sanctions that can be quite nasty.

In Toronto if you park during either the morning or afternoon rush hour you can not only expect to get a ticket for $150 but ALSO towed (much to the satisfaction of the other drivers that you are causing inconvenience to) costing you another $230 to get your car back. So if you avoided the towing and storage fees, count yourself lucky.

In Ontario police are allowed to pull you over to ensure that the driver is licensed, and that the vehicle is roadworthy and insured.

It certainly doesn't hurt to try. You can plead guilty to the charge right up until the trial begins. Besides requesting a trial gives you a host of other options and strategies for beating the charge outright.
