Putting stacks on a little truck like yours means it's only a matter of time before you get pulled over by MTO or a police officer to see if you have a muffler installed. No muffler means a ticket and there is no defense to the charge as the law is quite clear. So yes, I do recommend that you do have a muffler, better yet drop the stacks idea ...

Newer diesels (mostly after 2007) have emissions controls built into the exhaust but the old ones don't. In my opinion a diesel with a turbo and no muffler is considerably quieter than a diesel vehicle without a turbo and a muffler. Is this a reopening or an appeal?
Any delay that you cause cannit be used to argue that the trial took too long.
If they allow you to have a new trial you can ask for an 11b based on the time from when you were charged to when your original trial should have been, but that would depend on if you caused any of that delay.

You can say whatever you want in court. Will it give you reasonable doubt? If you were the JP, would you have reasonable doubt? It really depends on the strength of the officers testimony and what are in his notes. Courts have held that momentarily losing sight of a vehicle is not going to get you out of a conviction.

Unless the officer suspects that you are not who you say you are you are free to go with ticket in hand. There are a lot of ways the officer can confirm your identity, he is not going to issue you a ticket unless he is sure who you are.

Yes, they can be ticketed. Almost anything you do that is illegal is also illegal for bus drivers but there are exceptions, I don't believe the situation you described is one of them.

Question for others: Is it possible that the officer wrote the test time in his notes before he actually did? If you stretch it out as long as possible it might be a good way to handle this so one ticket drops off your record before the conviction for the 2nd one is registered. I would make sure you fully understand what your insurers policy is as it is unusual if they only hold a conviction against you for a year.
