It would be crazy to enforce the yellow speed sign as it only says the speed without the word max. That means, if enforced, you nedd to keep your speed at exact speed posted on the yellow sign, above or below is a violation.

That's right, i was shot with this once, it's an Ultralyte. Its manual claims to have a "wheather filter" button which allows the speed reading taken in rain, snow or fog.

Radar and Lidar are different, don't use both terms at the same time for the speed gun in question. Accuracy counts when you want to defeat the cop and convince the JP.

According to info you posted, you were in an accident and the cop came and gave you a ticket. I assume the cop did not see any of your not signaling and he issued the ticket based solely on hearsay of a witness.

If you knew who is the cop's witness, then look for both of them before trial. Under this scenario, if either one of them is not there ...

The Crown needs the cop and a witness to show up to testify that you failed to signal in order to have a chance of convicting you.

The witness or the cop might not show up and you have not got disclosure so far, my take is that the Crown would withdraw the charge, however come prepared.

As you said the cop relied on the witness statement to charge you. Ask for disclosure of witnesse statements, the cop and at least one witness have to be at trial for the Crown to have a chance of convicting you or case dismissed.

If both of them show up, you know what to do, delay the trial.

You can plead down to the "following to close" offered by the Crown but not before verifying that the cop and his witness show up. You can ask for disclosure which will tell you if there is witness to your careless driving and the witness must show up for the charge to stick

If you take it to court and take the plea bargain from the prosecutor i beleive the fine would be reduced to something like $60.

If he said there was no white van, then you won't find any evidence of the white van in his note or his testimony. You can bring up the white van in your own testimony at trial, but it'd better be relevant to your case or your argument regarding the white van is meaningless. The cop is smart enough to say in court that he had the speed gun on your ...

A better defence would be to ask for disclosure, and if you don't get a complete disclosure apply for a stay.

If you don't get disclosure at all, delay is crown's fault, and if delay more than 1 year, 11(b) will be a good defence.

Other way is to play hide and seek with the cop, if he shows up at trial you will not, instead your friend would be ...

1. Use this to your advantage when cross-examine the cop on the witness stand ie to discredit him in terms memory recollection of the event, if he slacked off on detail notes for his own reason it might back fire on him.
