The French Language Service Act (FLSA) requires all services and procedures to be in both languages. It applies to ALL communications. If the part of the certificate or notice of offence that the cop fills in is not in both languages it doesn't pass the smell test.

I am not saying leave out the TTC driver as a witness, i just want to weight the pro's and con's because things get more complicated when the TTC driver needs to be summoned or supeonaed.

I got one like that 2 years ago. I was not sure if there was 2 points so i called MTO twice and they told me there were 2 points.

He may have paced you both. In any case fill out the form to contest the charge then get disclosure which will tell you how he catched both of you.
Once you know how then send follow-up disclosure requests asking for more specific evidence.

If the judge grants me an adjournment, what is the next step I take? Do I find out my next court date immediately, or should I go to the office there and line-up to request a new date (like I did for my original Court Date)?

Ok, so let me see if I got this right. Here is my action plan.
(Sorry I had to break it down like this, but I'm really nervous about this..it being my 1st time appearing in court.. so I don't want to screw up! I'll likely carry this list with me!)

1. Ask prosecutor if cop is present. If not - case dismissed.

Re: Improperly Passing a Streetcar
They have a way of discouraging people from requesting disclosure. People don't get justice for free, it comes at a cost.
Let see, driver has to go in person to fill out the "Notice of trial", has to go in person to pick up disclosure, driver was given a court date not of his/her choice, now another $5 for disclosure (if disclosure is never sent ...

If the cop shows up, then you can take the pea bargain from the Crown who probably offers you 15 over or less which carries no point and less fine.
Alternatively you can fight the ticket with disclosure request and stay application for s11b and s7 charter of right.

You said that the police had no witness, how can he prove the careless driving charge in the court room? I think he will need a witness or the charge won't stick. There is a possibility that either of them will not show up. If they do show up, delay the trial.

You are right, you don't want to receive disclosure a few days before trial, so don't send any more request from now to trial date.
You can apply for a stay but i am not sure what the chance of being granted one is. If a stay is denied they may want to delay the trial even if the cop does not show.

File a "notice of intention to appear" if you have not done so, check the box challenge the police officer's evidence, and also check the box "interpreter required" if English is your second language.

Backroom bribery, i second that.
Cchapman, i got 2 tickets of this type (already posted in the forum) no left turn 7AM-9AM, one against a by-law, one against HTA.
Both charges were voluntarily dropped by the Crown when i showed up in court (Markham & 401) although cops were there on both ocassions.

Re: Disclosure, change court date
If the cop shows up, the prosecutor will tell you that he is there if you ask.
If the cop is not there (yet), the prosecutor could say "he won't be here today" or "he may be late" if you ask.
I would check the court docket first, if the cop's ID appears with many drivers names on the docket, i would guess he will show up.

It looks like there is witness other than the police officer required to make out the offense. Your disclosure will tell if there actually is. And if so both of them have to be in court for the prosecutor to secure a conviction against your uncle.
There may be a chance that one of them does not show.

The time frame is within the guide line of "unreasonable delay" for a s11(b).
If you are going for s7 (improper disclosure) for a stay, an additional s11(b) will strengthen the application.
