i too was super confused when media outlets were reporting during Operation Distracted Driving: ontario provincial/municipal police were targeting drivers drinking coffee, eating food, playing with stereo system and holding objects (paper & cards)

were they all charged under s78.1 or s130 Careless Driving?

from my experience through 11b pre-trial motion, was that neither the date you were charged nor the early resolution meeting was when the clock starts

the JP at my trial ruled it's the day you filed your tickets at the sardine office, and expressed your intent to fight the charges

the first attendance was ruled to be merely part of the trial ...

did this driveway have "no u-turn" signs along it?

legally you are allowed to do an u-turn anywhere unless it's prohibited by signage and if it doesn't conflict with the following:

Finally, if you want to plea to a lesser charge, I suggest choosing Option #3 and meeting with a Prosecutor prior to trial date. You can plea then, and with the new regulations coming into effect on March 31st, you can most likely go before the JP on the day you arrive to speak to the Prosecutor to have the charge entered. wait what's going to ...

filing the 11b closer to your trial IMO strengthens your argument; just think about your sworn statement, feeling prejudice 3 months after your charge or 11 months?

crown will most likely not offer the plea-bargain if you choose to argue the 11b

if your stay is denied, be prepared to go straight to trial w/o plea-bargain deal

your only course of action at this point is to request disclosure (officer's notes), and try to understand the charge from the officer's POV

only then can you mount a defence

maybe in the future when you see emergency vehicles, either move over one lane... if not while driving by, just slow down... get your daily dose of rubbernecking prescribed ...

you should take pictures of the pothole/intersection/officer's vantage point

i'm surprised they're actually getting serious about drivers making traffic congesting wide-turns; i highly support this step in the right direction, except for cases like this

a lot of Ontario's Finest make Left/Right turns so wide they go into multiple lanes blocking ...

you're going to have to resubmit your 11b application for the new trial, but this time updated with information that transpired during your last trial

the new delay will only strengthen your 11b

this isn't about changing weather conditions, this is about dangerous aggressive driving

the pickup selfishly changed lanes from L2 to L1 to overtake the small white truck

when he changed into L1 he tailgated the vehicle infront of him.. forced that vehicle to make a dangerous lane-change into L2

usually when people tailgate they move as far ...

i had a similar situation during my trial, where the crown argued that i formed my intentions to go to trial at the First Attendance meeting... so that's where my 11b clock was supposed to start

however you need to stand your ground, and argue that the date you filed your tickets at the sardine-office was the date you formed your intentions to go ...

how would Quebec police execute the parking ticket arrest warrant?

take you in with handcuffs in their cruiser to the nearest police station? and tow your car to an impound lot?

or do they escort you to the nearest police station?
