Re: Help: Careless Driving for Minor Bump <$1,000 No Injurie

Calling the police for a rear-end collision, will guarantee the at-fault party a Careless Ticket

The other driver will have to appear in court and provide witness testimony to the accident; if the other driver doesn't appear, the charges will be withdrawn

If the other driver does appear, you can plead down to S. 141 (5) 'Left turn ‑ fail to ...

Re: Turn not in Safety - Is this a valid defese?

the more appropriate charge imo should have been "Improper Right Turn" contrary to S. 141 (2)

http://www.e-laws.gov.on.ca/html/statutes/english/elaws_statutes_90h08_e.htm#BK218[quote]Right turn at intersection

(2) Where a driver or operator of a vehicle intends to turn to the right into an intersecting highway, he or she shall, where the highway ...

Re: Interest on unpaid fines??

unpaid tickets are sold to collection agencies for pennies on the dollar; ultimately there is a real possibility that unpaid tickets will go unpaid

collection agencies have lucrative access to your personal information/activity; if you started to use your credit card to make some big purchases, you'll start getting more frequent calls

i believe ...

you give one of the copies to the courts (where you initially filed your tickets), they will then give it to the judge on the day of trial

Re: What is proper disclosure ?

would the disclosure he received help him during cross examination to bring about reasonable doubt?

if OP were to ask, "what time did you test the radar, before and after the shift"... officer will:

A) say he doesn't remember
B) say it's standard practice to test before and after his shift
C) pull out a separate notebook (not-disclosed) with the ...

Re: If you lose in court...can they up the fine to $1000?

they will most likely seek the out-of-court fine indicated on your offense notice

if this was your 2nd, 3rd .. 4th time repeating the offense, then maybe... keep in mind the fine amount is upto the Justice of Peace; if you can show exception circumstances related to your financial stability, you might even get zero fine, or something ridiculously ...

Re: 35 over notice of trial mistakes/ disclousure request

If they sent a notice of trial to the wrong enforcement agency, does this mean there is a possibility the officer will not get his 'Notice of Trial'?

ergo, not show up to trial?

Re: No insurance card...

this will be at the discretion of the prosecutor, they will most likely drop the insurance ticket in exchange for a plea-deal for the speeding ticket

unfortunately the insurance ticket won't be dropped because he did have valid insurance at the time; he got the ticket because he failed to produce an insurance card which showed valid insurance ...

massive bump

do we need the full Niewiadomski case to use it at trial?

or can we bring cases available on CanLII where other Justices cite Justice Schnall's decision w.r.t. Niewiadomski?

how would we go about getting the Niewiadomski case or any other case not available on CanLII?

Re: Fire Routes - Private Property

not sure if Thornhill falls under the City of Vaughan or Markham, regardless... look online or call the city and find out their designated fire route by-laws, it should state clearly where the fire route is located

simply erecting a fire route sign, does not make it a fire-route unless there is an associated by-law that supports it

i don't think ...
