the "stop arm" does not have to be working for this to be an offence.

Here is the section for the offence:
HTA 175 (11) Every driver meeting on a highway, other than a highway with a median strip, a stopped school bus that has its overhead red signal-lights flashing, shall stop before reaching the bus and shall not proceed until the bus moves or ...

let's cut to the point - the intent of the law is to prevent a driver distraction, whether it is on a lap, facing the driver or 90 degrees. Simply...to prevent being stopped, have the person sit in the back seat or turn it off.

for kicks...I just took my laptop and put it on the front seat, with screen facing the seat, I can still see the screen ...

correct it is an offence....
HTA 78(1) No person shall drive a motor vehicle on a highway if the display screen of a television, computer or other device in the motor vehicle is visible to the driver

Visible = anything forward of the back of the driver's seat.

This is why all vans DVD system screens in the ceiling are placed at that point

Niagara to Grimsby is about 50km, which is not that far for a cruiser to be dispatched. I have also been outside my zone assisting another detachment area, to be dispatched back to the farthest point in my own area.

Lights/sirens are not required to be activated on a cruiser when travelling above the speed limit.

Parking offences go onto a vehicle, not directly into the hand of the owner, a follow up letter is sent (for an excuse maybe the owner was not driving or the offence notice blew off the window), whereas a ticket is handed directly to the person charged.

Probable cause = been watching too much tv from the USA.

Yes, a vehicle can be pulled over for fail to signal and then be given a licence plate light offence or BOTH offences could have been issued.

The officer used some discretion, rather than issuing a moving violation offence notice with 2 demerit points, you received an equipment violation ...

No discipline. Errors happen from time to time.
Now if an officer would make errors on a majority of tickets, then it would be an issue to deal with and find out why those errors are happening.

The red light has nothing to do with it.

Yield is the only thing to deal with. You have to yield to approaching traffic in the marked lane you are entering. You do not have to yield to those vehicles in the farther lane(s).

There is a similiar situation in the city I live in, except the merge lane, actually starts the right most marked lane ...

A summons allows the JP to issue up to the maximum fine for the offence unlike a face value on a ticket, which would be $110.

Probably to allows for sidewalk issues that the particular section was updated.

But, there is a "catch all" in the regulations, that covers unusual intersections/sing placement too.

ticket was received in the form of disclosure at first appearance and not at the scene .

None of that makes sense as a ticket is not disclosure.

Either you were
- issued Provincial Offence Notice (will have a $ amount on it) and chose the trial option, asked for disclosure and then received disclosure

- OR were issued a Summons (NO $ amount on ...

It is a Provincial Offence, not Criminal Code offence, so no criminal record. Upon conviction the offence will go on your driving abstract.

106(2) is for not wearing the seatbelt as prescribed.

However, if the belt is not operational then 106(1) applies

Given that the officer allegedly didn't see the seatbelt. Is this evidence ? My point would be that evidence requires you to actually see something, not seeing something is not evidence ?

The officer did not see something... "no use of a seatbelt".
