my understanding in both scenarios is that citizen/witness complaints were the inspiration for the charges.
Both to my understanding were internal investigations.
I saw the newspapers, but also heard through the grapevine about 50th person hand (more than 2nd hand) what happened......so what if anything is truthful on all that? Only the ...

Re: Interesting reading HTA 172
I'm not relying on the cases, I'm relying on what he Supreme Court said about law. Cops must be authorized by a valid law in order to do whatever it is they are doing. Wake up.
Please do not use case law in answers then, OR state why it affects the topic. That is why I stated what I did. When I read case law, I read into the situation and what ...

The instrument that is used at roadside is called an "Approved Screening Device" (ASD)most often is a Drager Alcotest 7410GLC. This instrument is approved by the Canadian Solictor General, and CFS (Centre of Forensic Science).
The Breathalyzer or Intoxilyzer are instruments used back at detachments/stations to get a actual number for how much ...

There is more to just HTA that we have to worry about. We have to follow the police services act as well of a vast array of internal policies.

Wish that were true! We have 2 of our officers charged with this offence while in cruisers, only reason the vehicle was not towed....well actually they were towed....on a flatbed!lawmen wrote:Emergency vehicles are exempt under the regulations.

Re: Interesting reading HTA 172
In order to be reasonable, seizures and impoundments must be authorized by law. Here, impoundment is not reasonable or authorized by a valid law. The reason for this requirement is clear: under both the Charter and the common law, agents of the state can only enter onto or confiscate someones property when the law specifically permits them to do ...

Re: Interesting reading HTA 172
Moreover, s. 128(14)(d) directly conflicts with s. 172.
Section 128 provides for a fine of $9.75 per kms over the speed limit when the driver is doing more than 50 kms over the speed limit. There is no licence suspension, vehicle impoundment, prison term etc.
There can be up to a 30 day licence suspension for HTA 128 (speeding).
If the ...

Re: Underglow
Although some is a greyish area, why draw attention to yourself and being subject to being stopped until an officer can either look the section up and decide what to do (charge or not). Keep it simple flip a switch to turn on the lights and show them in parking lots and car shows, turn them off on the highway. Might save you extra 15-30min (should ...

Re: GPS
Hwybear-did you calculate the speed accuracy from your cruisers odo, or radar? Just wondering, because at the local racetrack(1/4mile), my Garmin GPS was very accurate in giving me my top speed compared to the readout from the tracks timing system.
On 3 different cruisers, 3 different radar units, the GPS reading was 2km/hr higher than what the ...

Re: Disobey Sign 182(2)
Bear I understand HTA 154, but I don't see anything about solid or dashed lines, yellow or white, merely stay in a proper lane and how to change lanes. Nothing about crossing a solid white line. Comments?
Correct, nothing preventing crossing the lines.......but normally the lines are placed in areas where other offences might apply.....no clear ...

Re: Disobey stop sign - Fail to stop HTA 136(1)(a)
Now, here's what makes it slightly more interesting. After she passed the stop sign, she did notice that there was a cop car that came out of nowhere and followed her. The flashing lights were on, but there was no sound of a siren. She had never been stopped by a police car before, and it didn't occur to her that she might've done something such ...

Thank god I don't work the GTR area.....the mentality of a lot of drivers is just whacked.
If one could get thru to these blocks of concrete (heads) on how to drive it would reduce the congestion and speed up traffic
- travel at the speed limit
- merging people come on and actually merge at highway speeds
