Section 216(1) is an absolute liabilty offence while s. 216(3) is a mens rea offence.

What ever happened to basic driving and seeing a sign (ie big red octagon sign saying STOP and the vehicle doing so) and doing what it says. Certainly if the sign were to say FREE GAS everyone would be obeying that :lol:

I see the other side by what is said, but most offences is getting way way way beyond the basic principle itself into this ...

If a suspect is bleeding in his mouth, his blood is constantly providing a "fresh" supply of alcohol to his mouth, the same as the mouthwash would. I don't see how this wouldn't affect the machine.

Law is so vast its not really possible to know everything even if one is a cop. Most people exect cops to know everything, though. .

Got that right....not just a simple ticket book and out onto the road. Carry at least a duty bag (small suitcase) packed with variety of books to look up laws, maps, reports, etc...if I want to branch off for a day ...

You are not understanding "mouth alcohol affect".

Mouth alcohol is residual alcohol in the mouth. This is caused by the last "swig" of beer and then blowing directly into the instrument, where the alcohol is fresh in the mouth, therefore a false/high reading is obtained.

Same can be done with mouth wash, contains alcohol, swish that around, spit ...

Do these machines have the ability to detect the presence of blood in the breath sample? Perhaps I have such poor dental hygiene that my gum's bleed. I blow into a machine designed to test for alcohol levels in "breath". Is the breath sample not contaminated and inaccurate?

my understanding in both scenarios is that citizen/witness complaints were the inspiration for the charges.

Moreover, s. 128(14)(d) directly conflicts with s. 172.

Section 128 provides for a fine of $9.75 per kms over the speed limit when the driver is doing more than 50 kms over the speed limit. There is no licence suspension, vehicle impoundment, prison term etc.

Hwybear-did you calculate the speed accuracy from your cruisers odo, or radar? Just wondering, because at the local racetrack(1/4mile), my Garmin GPS was very accurate in giving me my top speed compared to the readout from the tracks timing system.

Thank god I don't work the GTR area.....the mentality of a lot of drivers is just whacked.

If one could get thru to these blocks of concrete (heads) on how to drive it would reduce the congestion and speed up traffic :shock:
