License plates in Ontario come with a 5 year warranty. They can be replaced at no cost as long as the damage is considered a defect.

Apparently, old plates used a slower process where the aluminum was painted on directly and baked on. The new process involves printing the plate on reflective vinyl sheets and it's adhered to the aluminum plate ...

Just a suggestion but the court system in Toronto is very backed up... If you get any kind of ticket in Toronto (parking, red light, speeding) you should plead Not Guilty and get a Trial date. Most likely the trial date will be outside the "speedy trial" Charter 11(b) and you can then apply to get it dropped because of that.

But how would the police officer know who was driving the vehicle?

Those are going to be two different issues. The officers believe they have enough evidence to charge you. Therefore, whether or not you leave you vehicle doesn't change whether or not a charge can be laid. They can, they will, and you will be convicted should there be enough ...

Yes. Just because you park your car and get out doesn't mean the officer automatically loses any right to charge you.

1. The ticket doesn't state where the offence occurred, e.g. highway X at street.

It wont go into that much detail on your ticket. You'll have to request disclosure. The officers notes should have more detail about the exact location your speed was calculated, how it was calculated, etc. Example, if there had been radar enforcement, it'll list ...

I read on here, i saw many of members here got their Driver License suspended for not paying fines, do they suspend driver license if you don't pay parking ticket though ?

Looks like we'll have to disagree - case law states there must be an independent witness who can essentially tell the court just how close the offender was - fact there was an accident is not proof in-and-of-itself - no witness, no conviction, as I stated above.

Thanks for your response, just one more point. We didn't receive the validation stickers for 2014 & 2015 but shouldn't it popup on the officers computer that the permit is still valid?

Whether or not the officer could have somehow come to the conclusion the permit was valid at the time of stop may be an irrelevant point if there is a regulation ...

In order to obtain a conviction at trial the prosecution must have a witness who can testify as to the closeness of the following vehicle.

To the second part, it is impossible to know if he had his license on him WITHOUT stopping him first. If they weren't legally permitted to stop him, that evidence would NOT be admissible in court, and cannot be used to prosecute him - in other words, there's absolutely no case if you can prove the stop was unlawful in the first place.

at renewal, will they see me as having "2" convictions

thats true, but the term "accident forgiveness" which you sometimes pay an extra premium is for at fault accidents not traffic tickets.
And also the forgiveness is ONLY for that company at renewal,
if you have AF and change companies, its not valid.

You could show your valid insurance but it doesn't mean it'll necessarily go away.

You were charged with not surrendering that particular valid document when prompted. You were not charged for driving without insurance.

People sometimes use the full clear plastic to protect the plate, especially if its a vanity plate... whats the issue?

Yellowing, oxidation, pitting, glare, etc. Some people also want to believe "clear" means tinted (black, blue, etc). The issue is a lot of times they interfere with the reading of a plate, whether by an officer, toll, or another ...

You can't have more passengers than there are seat belts. Older vehicles made before a time where seat belts were mandatory (1974 I believe) have been grandfathered in. Even then, you can't transport infants or small children. You, the driver, are responsible for anyone under the age of 16 in any vehicle with belts.

You can request disclosure. The officer would have written down all the relevant information regarding your stop (how he determined your speed, when, where, etc).

Hi guys, I got caught past Woodbine Ave, and officer says I was going over 30 on a 70km/hr. I was not over 30, but maybe over 20-25, but it's his words against mine.

Speeding is an absolute liability offense. You were either speeding or you weren't. There's no in between. "I was speeding, but..." means your trial is already over before it begins ...

When approaching a school bus, I don't believe there's a minimum distance required as long as you remain in front of it. If coming from behind, you're required to stop at least 20 metres behind. That's so the driver can see your vehicle.
