Re: 42km Over, Cannot Request Disclosure, Need Advice
Is there really a point to requesting my disclosure this close to the trail? (it is in approximately 4 weeks from this post). At first I thought the disclosure problem (receiving the trial notice 10 weeks before my court date, and the letter claiming disclosure needed request minimum 3 months prior to the court date) would be a way to get out of ...

Re: Red Light Camera ticket while turning right
my car is seen turning left in the second picture the first picture is of me at the line
you can see my break lights and my turn signal
I'm going to assume you mean right and not left as you already pointed out you were turning right.
Correct, the first picture will always show you at the line. The point of the first picture is to show your ...

Re: Red Light Camera ticket while turning right
These cameras activate through speed sensors. They activate at something like 20km+ the moment your vehicle is in front of the line. The first photo should be your vehicle right on the line along with red light. The second photo will show your vehicle proceeded through the red. Sometimes your vehicle wont be in the second picture. That's because ...

Re: Clear Plate Covers
If an officer has a problem with it, there's nothing stopping him from charging you.
Maybe it glares at certain angles...
It gives off a weird reflection at night with the plate light...
The pits from rock chips are starting to take a toll on the clarity...
The plastic is starting to yellow with age...

Re: Plead or Request court date? (Worthwhile?)
Now when somebody is charged as a OWNER instead of a DRIVER then it does NOT show up on your record and does NOT affect your insurance at all. So at the meeting you could ask the prosecutor if they would be willing to charge you as the OWNER instead of the DRIVER. Again the prosecutor does not have to do this, but maybe they are in a good and ...

Re: Failing to stop for a school bus G2 driver
The only reason I would believe a summons would be issued is if he was charged under 175(19) as the owner. Was the summons issued the same day, or more than 30 days but less than 6 months after the incident? If the summons was issued the same day then as above states, he had to receive a summons for another non-ticketable offense.

1/ Can the prosecutor at this level reduce the ticket to something lesser? I don't care about the points, I care about the charge. [/size]
Handheld device is already falls in the minor bracket when it comes to insurance. There's nothing lower than that. If you're worried about the charge, getting it reduced is probably not going to help you much ...

Short answer is they don't care. If anything, it makes their lives easier not having to explain every little thing to someone who doesn't know what's going on. A JP will not hesitate for a second to recommend you seek out representation.

Re: HOV Lane during the Pan AM games please help trial soon.
if you can get the footage from a QEW camera that shows it was not you, then you will win. But getting that video footage will not be easy. Most likely if you ask for it in disclosure they will just say it does not exist.
If you ask them they will ignore you, because disclosure doesn't work that way. They are not using video from these cameras ...

if driver had hit another car and or seriously injured that person, what would have been the repercussions.
i.e. he was NOT insured at the time to drive; with essentially the plates from another car
The repercussions are that you get sued for hundreds of thousands of dollars and everything comes out of your own pocket.

Officers are allowed to lose sight of a vehicle. To suggest two different vehicles with different body styles made the old switcharoo while he checked his mirrors is grasping. It also happens frequently that an officer will write down black for a blue car or black for a dark brown car. There's a million different paint codes available and this ...

Re: Speed Limit Sign Posting?
Then how can a speed limit reduction on a 4 lane road be legally enforced?
I'm not sure I follow. How could it not be enforced?
I'd agree with everyone in this thread. Signs only need to be posted on the right side of the road. If there's no signs, follow the default speed limit. There is no requirement for signs on the left side.

Re: GOING WITH FLOW OF TRAFFIC
Can i use this as my defense in court ?
Short answer is NO. Long answer is below....
There is no such thing as "going with the flow of traffic" when it comes to tickets. You're either speeding or you're not. If you notice drivers moving faster than you, move to the right lane and let them pass on the left instead of trying to keep up. If you ...

Re: Fail to Stop for School Bus- Owner - 175 (20)
Just curious.. is there an official source online or elsewhere that says that owner offences don't show up on an abstract?
The conviction goes against your plates, not your license. If you don't pay, you can't renew your plates. Just like a parking ticket, red light camera, or any other offense where you are charged as the owner.

- If the weather is so bad that you can't make out objects in front of you, the logical thing to do would be to safety pull over and park. This argument comes up quite often on these boards. What you're essentially saying is "I couldn't make out the objects in front of me, so I continued driving blind with no regard for what's in front of me ...
