33 over should be considered a minor offence, which may or may not increase your rates.
Demerit points will be applied based on what the offence would carry in Ontario (3 points). You may be sent a warning letter from the MTO, but there is no associated suspension or other penalty.

Did the police attend? Typically if you're going to be charged, they would do so right at the scene of the accident.

Re: Points erased, insurance still increased??
The term "no fault" is a bit misleading. It simply means that regardless of who is at fault in an accident, you deal with your own insurance company. Your company will pay for all your losses rather than requiring you go through the at fault drivers company. Also note that even if the police dont lay a charge, the insurance company will still ...

Insurance companies look at all HTA convictions, not just those with demerit points. I also believe they look at all reported accidents, regardless if a claim was made or not.

1) You can actually receive multiple suspensions on your licence at the same time. So even if youre already under suspension for support payments, you can be given another suspension for non-payment of fines.
2) It would be rare for an officer to simply ignore a suspension. My guess is that the officer either never checked the status of your ...

Youll need to request disclosure and see what evidence the Crown has and how they obtained your speed. Slopes and angles wont typically affect the accuracy of stationary speed measuring devices. Radars will show a lower than actual speed at sharp angles, but since the error benefits you its of no real use in Court.

You wouldnt have a criminal record until youre actually convicted of an offence. Regardless, outstanding charges can still show on a background check.

Request disclosure and see what evidence the officer is basing the charge on. If there is no evidence to support the charge, the Crown will likely withdraw it. If witnesses say you made an illegal pass, you may need to go to trial. You can certainly take the initial steps yourself and hire a paralegal/lawyer later down the road if needed.

As long as you were in a different marked lane then the vehicle that stopped, you did nothing wrong. Im thinking the officer is under the impression you passed the vehicle while in the same lane.

1) Its not really a lie. A first attendance meeting is a more private affair where you have more time to review the matter and talk with the Crown one on one, versus on the day of the trial in Court. Yes, you can still talk with the Crown, but it's not a proper meeting.

Okay, I misunderstood. I thought you meant you're from Alberta but got charged in Ontario. I have no familiarity with the Alberta traffic laws so you can disregard my post.
In future, I'd suggest posting such questions in the "Offences Outside Ontario" message forum. Might get more responses from non-Ontarians.

I think trying to suggest you should have been charged with a more serious offence is a poor idea to say the least. I also think youre going to have an uphill battle trying to argue that drifting on a public highway demonstrates due care. Id suggesting getting a professional to represent you.

As stated above, fatal errors dont apply when you receive a summons. Unlike regular tickets, theres no out of Court settlement where you can just pay a set fine and be done.

Your questions are pretty common ones, read through the forums and you'll probably get some good ideas of your options and what other people have done.
The ticket may impact your insurance, but you'll have to contact your provider to see if so and by how much.

I remember reading about it in the local newspapers at the time. As the accident occurred on private property, the applicable charge would be "Fail to report accident" contrary to section 199 of the Highway Traffic Act. Thats only if the total damage (i.e. your vehicle and the vacuum, etc.) exceeds $1,000. As you said, probably would have been best to deal with the matter at the time, but whats done is done ...

In Ontario, the Crown can offer a plea deal to the same offence but with a reduced fine. It's quite possible it would be the same for Quebec matters, where they negotiate a reduced fine in exchange for a guilty plea.

Youll have to start by requesting disclosure and seeing what the officers actual evidence is, namely how they measured your speed and where they did it from. Without knowing when/where they obtained your speed, its pretty hard to know what your chances are in Court. For all you know they could have been travelling in the opposite direction and ...

My understanding is that X-Copper and similar firms do have lawyers on staff or at least act as referral agents to attorneys who can properly represent you.
Id certainly make sure though that its a criminal lawyer who reviewed your file.

Normally you'd be charged with driving under suspension and careless driving. On a first offence you'd be looking at just over $1,300 in fines and an additional 6 month licence suspension.

Nice win for you!
That part bugs me. The Crown certainly can withdraw a charge if they feel it's unwarranted or the evidence doesn't support it. Not sure if they were just trying to placate you or what, but glad it worked out in the end.MegaSilver wrote:He agreed that careless wasn't a warranted charge, but could not dismiss the charge.

The problem is that not everyone simply accepts a reduction and pleads guilty. Many people still try to fight the ticket or seek a further reduction, so theres not always much incentive for the police to offer reductions. And while lowering speeding tickets is pretty common, at the end of the day the officer charged you for the actual offence you ...

Yes, you'll want to select option 3 and request a trial (even if you don't carry through with the trial). You're correct in that the Courts could never cope with every person going to trial, but that's why they offer deals, most people accept a plea. You may luck out and land in 11B territory, but it's far from certain.
