33 over should be considered a minor offence, which may or may not increase your rates.
Demerit points will be applied based on what the offence would carry in Ontario (3 points). You may be sent a warning letter from the MTO, but there is no associated suspension or other penalty.

The term "no fault" is a bit misleading. It simply means that regardless of who is at fault in an accident, you deal with your own insurance company. Insurance companies look at all HTA convictions, not just those with demerit points. I also believe they look at all reported accidents, regardless if a claim was made or not.

Youll need to request disclosure and see what evidence the Crown has and how they obtained your speed. Slopes and angles wont typically affect the accuracy of stationary speed measuring devices. Radars will show a lower than actual speed at sharp angles, but since the error benefits you its of no real use in Court.

You wouldnt have a criminal record until youre actually convicted of an offence. Regardless, outstanding charges can still show on a background check.

Request disclosure and see what evidence the officer is basing the charge on. If there is no evidence to support the charge, the Crown will likely withdraw it. If witnesses say you made an illegal pass, you may need to go to trial. You can certainly take the initial steps yourself and hire a paralegal/lawyer later down the road if needed.

As long as you were in a different marked lane then the vehicle that stopped, you did nothing wrong. Im thinking the officer is under the impression you passed the vehicle while in the same lane.

1) Its not really a lie. A first attendance meeting is a more private affair where you have more time to review the matter and talk with the Crown one on one, versus on the day of the trial in Court. Yes, you can still talk with the Crown, but it's not a proper meeting.

I think trying to suggest you should have been charged with a more serious offence is a poor idea to say the least. I also think youre going to have an uphill battle trying to argue that drifting on a public highway demonstrates due care. Id suggesting getting a professional to represent you.

As stated above, fatal errors dont apply when you receive a summons. Unlike regular tickets, theres no out of Court settlement where you can just pay a set fine and be done.
