Re: Red Light Camera Ticket

By your own admission you committed the offence. Red light offences are absolute liability offences, meaning the only possible justification is if your own life was in jeopardy.
Even police officers responding lights and sirens to an emergency calls get charged with red light camera offences if they don't come to a full stop at red lights before ...

Re: Fatal Error on Summons?

In my experience, fatal errors would be things like no date, wrong or missing act or section number, no defendant listed, no signature of officer, etc..

Well thats what I'm trying to fiqure out. If "no signature" is a fatal error does that constitue the ticket being quashed? Here's what Ticket Combat has to say on it:

The fatal errors you've ...

It's difficult to say what your chances of getting a further reduction are. It will really depend on the Crown who is dealing with you on that particular date.

In my experience they're less likely to further reduce a ticket that already has been, but your original reduction was relatively minor and you're not asking for much more.

Not sure how easy it would be to re-open. I'm guessing it would be difficult.

Do you actually have a defence to the drive suspend charge? You may not like the fine, but your plea is for a much less serious charge.

Drive suspend would carry a higher fine, possible further suspension and even jail time if you have prior convictions. Probably also ...

Contact your insurance provider in regards to possible rate increases. Some care about points, but most have their own list of what they consider minor/major convictions. Most will forgive one minor conviction or two. Some may consider no licence a minor offence.

Re: 70 in 50km/h zone. should i fight?

Some quick answers to your questions:

1) Incorrect offence location (marking the intersection where he stopped you versus where he observed you) is not a fatal error.
2) Depends on the area where you were stopped. Built up areas (pretty much anywhere in a city) the speed limit is 50 km/hr unless otherwise posted. If it was a rural area you might ...

Stunt driving isn't simply for going 50 km/hr over the limit, but includes numerous other driving offences.

From your description of events, your driving sounds like it could fall under the following section:

For the purposes of section 172 of the Act, "race" and "contest" include any activity where one or more persons engage in any of the ...

Re: Driving while suspended/ no license

Did you receive a summons to go to Court, or just a regular ticket with a payable fine on the bottom? If it's just a regular ticket, then the fine is the most serious consequence. If they actually gave you a summons with a set court date, then they could be seeking a higher penalty.

The charge of driving with no licence means you've either never ...

Re: Does a police officer ever have to issue you a ticket?

What's your opinion on the Stunt Driving Legislation? Because the section uses "shall" instead of "may", many officers argue they have no discretion. If you have reasonable and probable grounds to believe a stunt driving offence has been committed, you shall proceed with the charge, suspension and impoundment. It's almost like domestic violence ...

Does this ticket affect insurance?

The OP is wrong, it can affect your insurance rates. Most companies would consider unnecessary noise a minor conviction regardless of the circumstances.

By your own admission, you didn't make a full stop before turning right on a red light. The law states you MUST stop, regardless of traffic. It's also an absolute liability offence, meaning the only defence is one of absolute necessity (i.e. a giant steam roller was about to plow into the back of you).

If you pay off all outstanding fines and a reinstatement fee, your son should get a new licence. Might have to start over as G1 though depending on how long he's been suspended and what level he was at prior to the suspension.
