Re: Disobey Stop Sign/ Fail to stop Sect 136 (1) (A)

Here's my two cents:

During your disclosure request (where you will ask for the officer's notes) ask for an explanation & clarification of the charge. The E & C is trying to see if the Crown figures out that they need to give you a certified copy of the by-law that erected the sign. This is required. If the Crown does not provide you with the ...

Didn't the article mention that he was charged with driving without insurance? I thought that carried a minimum $10K fine all on its own, with the JP having the discretion to drop it a bit if your sob story is good enough.

It did. First offence for drive without insurance is minimum $5000, max $20 000, but you're right with the JP having ...

Re: Following too close alternate charge?

Now today I had my car brought in to have it safetied and e-tested as I'm looking to sell it and I hear back that the brake lines have a break in them.

That makes things a little more interesting. You were following another vehicle at the posted speed limit who suddenly braked. You then did not hit the vehicle while your car had defective brakes ...

The notes also enable a person to understand exactly how they were caught, or other things that they may not have considered or noticed. It may cause the defendant to plead guilty, or may help their defence. Example: Defendant is driving on a sidestreet. Defendant sees police car behind him. Upon spotting police car, defendant takes careful note to ...

The photos are one piece of the puzzle. If the by-law requires the sign to be present, it might cause the Prosecutor to withdraw the charge if presented with photographs. All depends on municipality.

Re: Parking in Fire Route... Apparently

Think you're right, Squishy & viper1. Fire route is governed by municipal by-law. As viper1 was mentioning... which city did this occur in?

Jenne: Take some photographs of the area with a time-date stamp on it showing that there are no signs indicating that it was a fire route. Be forewarned, though, that whoever takes the photograph will be ...

Re: help ! How to reschedule my trial date

On top of that, they forgot to include a certified copy of the by-law that erected the STOP sign. That's also grounds for staying the trial based on improper disclosure. In your next disclosure package, ask them for an explanation and clarification of the charge, but don't specifically ask for the by-law. See if they figure it out.

If they try to ...

Correct, bilingual defence applies. Take a photograph of the sign with a time-date stamp on it to provide proof that it is not bilingual. (Be forewarned: Whoever takes the photograph has to be present for the court appearance.) Ticketcombat's website also provides a thorough explanation of how and when to use bilingual defence, if you haven't ...

There is also that group of drivers who think the left lane is the 'passing lane', the centre lane is the 'travel lane', and the right lane is the 'merge lane'.

Re: HTA 144 (9) - Time issue

Not sure about setting official time with respect to how accurate the police have to be. But, it's likely that they'll consider the officer's version of events as more reliable.

There are several ways of fighting it, though. The timing issue is, I would think, more of a "last resort" defence than anything should it go to trial. There are other ...

Re: Failure to Obey a sign

Short answer: No. There has to be a very serious error on the ticket for it to be voided. All of the mistakes can be fixed/amended unless they're something like missing offence date, missing defendant name, missing offence, or something like that.

There are other ways to fight this, however. What city did the offence occur in and was the sign ...

Re: *Updated, excerise my option to speak to a proscutor or tria

Couple of points: Be careful about "explaining" yourself to the Prosecutor. Some people in First Attendance meetings admit that they were speeding or whatever, the Prosecutor immediately stops all attempts to accept a bargain and goes right to court, then uses that statement against them! Not saying you would make that error, but it has happened ...

Just today, there was an EMT Tahoe followed by a fire truck coming in the opposite direction from me. There was a concrete median and heavy traffic on my side, so I put on my four-ways but didn't stop (was watching for any indication that they would jump the median). Some guy in the opposite direction (same as the EMT) just stopped in the middle ...

As for "option 4: speaking to the Prosecutor," I can't say for sure if it is First Attendance or not. (Probably is.) Technically speaking, it wouldn't be so much a case of the Prosecutor "finding you guilty" as refusing to accept your offer. May be worthwhile placing a phone call and finding out what the option means.

Were there multiple officers ...

Nicely said, racer.

Although one update: The York Region Police are now recommending to the Crown that they drop the charge against the 15-year-old boy who punched the bully in the face. That kid should never have been charged in the first place. The school board also really screwed that one up.

Aerial surveillance is an excellent way of keeping the subjects in sight without putting other officers/civilians at risk. Even crotch rockets can't really outrun the OPP's C-206. On the subject of fleeing, apparently there was a police pursuit that began in York Region and ended on the 401 near Avenue Road after police initially spotted what ...
