Usually, lidar guns are not affected by power lines, but I don't have one and can not testify in a scientific manner.

I think that what Radar Identified was getting at was that if Officer "A" tags a car then Officer "B" tags a car, was there time to run the test(s) in between and does the test by one officer count as the testing by the second officer, i.e. If Officer "A" tests after he stops a car can Officer "B" use that test, in his notes, as his before the ...

On Sunday, Halton Regional Police clocked a GMC pickup truck going 168 km/h in a 60 km/h zone in Burlington. (Think it was Appleby Line.) He was a G2 driver and was also charged with stunt driving.

Were there multiple officers using the same lidar device or just one? This makes a difference (care and control of the device). If several officers were using the same device, did they each test it before and after each person was stopped? Did anything happen to the device during the time it was used by the other officers? My fine was $320. That was the total payable. That is on my ticket, and on my notice from the court (telling me when to show up etc). Why is this a bigger deal than I think? What else could happen?

There's no numerical answer, particularly since our population is growing. Ontario has the lowest fatality rate per vehicle-kilometre in North America. We had this before bill 203, before the change to the drunk-driving laws, etc. Our injury and collision rates are high thanks to the GTA, but most of that is because of idiotic driving.

Although the officer specifically said "Speeding" on the ticket, he didn't say by how much. It's pretty close to a "fatal error," so you should be able to use it to fight the ticket. The reason being, a missing offence is a fatal error which should void the document. It seems like he meant to reduce it to 70 in a 50 zone. Without the speed, you ...

When did you make your first disclosure request? The Crown is under no obligation to make any disclosure until it is first requested by the defendant. If it was at the five-week mark prior to the trial date (which is the impression I got), that might not be sufficient time for the Crown to put it together and the JP may not grant a stay or quash it ...

There are a couple of ways of getting it reduced or dropped. If the 407ETR can read the plates, I still think a ticket for a yellow tinted plate covering is a little overboard... but that's just my opinion. (Doesn't mean my opinion works in court.) What police service did the officer belong to? Some are more likely to show up for trial than others ...

You may also be able to talk to the Prosecutor about offering to plead guilty to some of the infractions in exchange for dropping others. For example: Could offer to plead guilty to 30 km/h over speed limit plus fail to remain in lane in exchange for dropping the insurance & registration, or maybe 40 over in exchange for dropping all others ...
